<br /> .. <br /> S-Þ <br /> CITY OF SAN MARCOS, TEXAS <br /> Supplemental Electric Service Agreement Page 5 <br /> 4.2 Customer shall have the right to install, equip and maintain, at its own expense, <br /> suitable instruments adjacent to City's metering equipment for the purposes of a check <br /> of City's metering equipment. <br /> 4.3 From and after the date of this Agreement, the Parties agree the City shall own and <br /> will be responsible for the maintenance of all required metering equipment used in <br /> computing Customer's monthly bill, other than the check metering equipment provided <br /> for in Article 4.2 of this Agreement. <br /> 4.4 The Parties agree that metering equipment has and will be installed on the Customer's <br /> premises near the Delivery Point at a mutually agreed upon location. <br /> 4.5 The City will, at its own expense, make periodic tests and inspections of its metering <br /> equipment at least once a year in order to maintain the accuracy of such metering <br /> equipment within 1.0% slow or fast. The City will make additional tests or inspections <br /> of its metering equipment at the Customer's request. If such additional tests show <br /> that the metering equipment is accurate within 1.0%, slow or fast, no adjustment will <br /> be made in the Customer's bills and the costs incurred by the dty in making the test, <br /> including all appropriate overheads, will be paid by the Customer. <br /> If any test shows the metering equipment to be slow or fast in excess of 1.0%, an <br /> adjustment will be made to the Customer's bills for the period the inaccuracy existed, <br /> if determinable, or one-half of the period (not to exceed six (6) months) since the last <br /> previous meter test if the period of inaccuracy is not determinable, and the cost of <br /> making the test shall be borne by the City. <br /> The Customer will be advised of the times of meter tests and may have a witness <br /> present to observe such tests. ' <br /> I . <br /> ARTICLE V <br /> PARALLEL OPERATIONS <br /> 5.1 The City recognizes the Customer has operated the Facility in parallel with the City <br /> System and hereby grants its approval for the continued parallel operation of the <br /> Facility so long as such operations are conducted safely and in accordance with Good <br /> Utility Practices and the terms and conditions of this Agreement. <br />
