<br /> 5E <br /> CITY OF SAN MARCOS, TEXAS <br /> Supplemental Electric Service Agreement Page 6 <br /> 5.2 The City reserves the right to interrupt service to the Customer at the Delivery Point <br /> or to isolate the Facility from the City System at any time during a parallel operation <br /> by the use of automatic protection devices or otherwise when such action by the City <br /> is reasonably determined by the Director or his designee to be necessary for the <br /> maintenance or repair of City equipment and facilities or for the protection of persons <br /> or property. When time and circumstances permit, the City shall provide the Customer <br /> with as much advance notice as is practical prior to such service interruption. <br /> 5.3 Pursuant to Good Utility Practices, the City shall have the right to specify and require <br /> the Customer to install on Customer's premises and at Customer's sole cost such <br /> additional protective devices as the City may reasonably determine necessary to <br /> protect the City System and persons. <br /> 5.4 The Customer agrees to maintain its electric system and the Facility in a thoroughly <br /> safe and efficient operating condition at all times in accordance with Good Utility <br /> Practices. <br /> .. <br /> 5.5 The City reserves the right to discontinue parallel operations with the Customer's <br /> Facility if the Customer does not install the protective devices requested by the City <br /> pursuant to Article 5.3 of this Agreement or operate and maintain its electric system <br /> and the Facility in accordance with Good Utility Practices. <br /> 5.6 Upon reasonable notice to Customer, the City shall have the right at all times to enter <br /> the Customer's premises to read meters and inspect, repair, remove and replace the <br /> City's equipment located on Customer's premises and inspect all of the Customer's <br /> equipment, facilities or devices associated with the Customer operating the Facility in <br /> parallel with the City System. , <br /> 5.7 Except for the protective devices installed by the Customer at the request of the City <br /> pursuant to Article 5.3 of this Agreement, the Customer agrees it shall have the sole <br /> responsibility for the design of its electrical facilities and that any approval or <br /> certification by the City of any Customer owned facilities shall not be construed as an <br /> approval, endorsement or recommendation of a particular design or a representation <br /> that such design is suitable or adequate to service the Facility. <br /> 5.8 Should the primary voltage feeder normally utilized by the City in providing service <br /> hereunder be disrupted, at the Customer's request the City will provide service to the <br /> Customer through the "Live Oak Standby" feeder and the Customer agrees that during <br /> such emergency: <br /> + the Customer will disconnect the Facility from its system and absolutely <br /> no electric generation will be allowed; <br />
