<br /> 'LID <br /> (11.5) Take-out or drive-through eating <br /> establishments having. no indoor dining: One <br /> parking space for each 50 square feet of floor <br /> space used or designated as customer service <br /> and waiting area, or four spaces, whichever is <br /> greater. <br /> SECTION 19. That Section 37 (B) (1) (c) of Appendix A, <br /> General Zoning Ordinance, of the San Marcos Code of <br /> Ordinances be amended with regard to the adoption of Federal <br /> and State design and construction standards for accessible <br /> off-street parking spaces to read as follows: <br /> ..-,~ <br /> (c) Accessible parking spaces for persons with <br /> disabilities: <br /> (1) Off-street parking spaces shall be reserved <br /> for the physically disabled in an amount <br /> not less than that required by the <br /> Americans with Disabilities Act <br /> Accessibility Guidelines. <br /> (2) Each parking space reserved for the <br /> physically disabled shall conform to the <br /> identification requirements of the Texas <br /> Department of Licensing and Regulation <br /> promulgated under State law, and the design <br /> specifications enumerated in the Americans <br /> with Disabilities Act A<:cessibility <br /> Guidelines. <br /> (3) Current copies of both the State and <br /> Federal regulations are available in the <br /> Department of Planning and Development <br /> Services. <br /> (4) State law offenses for improper use of <br /> parking spaces reserved for the disabled <br /> upon private property shall apply within <br /> the City. Any, peace officer, and any <br /> person designated by the city manager to <br /> enforce parking regulations may issue <br /> citations for such improper use. <br /> SECTION 20. That Section 37 (B) (15) of Appendix A, <br /> General Zoning Ordinance, of the San Marcos Code of <br /> Ordinances with regard to landscaping requirements for <br /> off-street parking to read as follows: <br /> (15) All parts of an outdoor parking area or lot not <br /> occupied by parking spaces or driveways shall be <br /> landscaped with grass, shrubs, ground cover, <br /> and/or paved pedestrian paths. The following <br /> additional requirements are intended not only to <br /> improve the appearance of large paved areas, but <br /> also to provide for adequate circulation and <br /> drainage, to freshen the air, and to help <br /> moderate wind, noise, and temperature extremes. <br /> (c) One tree of at least 2-1/2" caliper in size <br /> shall be provided within the perimeter of the <br /> parking area for each 250 square feet of <br /> landscaDina reauired. <br />
