SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction. <br />SECTION 5. After its original passage, this ordinance will be subject to reconsideration <br />at the next regular City Council meeting. This ordinance shall become effective upon the <br />completion of both of the following events: a. delivery to the City of San Marcos of a fully <br />executed right of first refusal to purchase a 31.25 acre tract of land described in Exhibit A -5, in a <br />form acceptable to the City Attorney and valid for a period of one year; and b. delivery to city of <br />a contractual agreement, acceptable to the city staff, that obligates the owner of the Project Site, <br />its successors and assigns, to provide adequate shuttle bus service at the property owner's <br />expense, to transport residents to and from Texas State University – San Marcos until such time <br />as the university provides such service. The City Clerk shall note the effective date of this <br />ordinance in the official records of the city when the conditions stated in this Section 5 have been <br />satisfied. <br />PASSED, APPROVED AND ADOPTED on January 7, 2013, subject to <br />reconsideration at the next regularly scheduled City Council meeting on January 15, 2013. . <br />Reconsidered: yes—X— / no The conditions stated in section 5 <br />have been satisfied.
