Development District, a 0.651 acre, more or less, portion of Project Site (as described in <br />Exhibit "A -4 ") currently zoned "CC" Community Commercial District and the remainder <br />of the Project Site. <br />2. Subsequent to the public hearings, the Planning and Zoning Commission on <br />November 27, 2012 considered and voted to recommend that the requests be approved by the <br />City Council of the City of San Marcos. <br />3. The City Council held a public hearing on January 7, 2013 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan <br />is revised to change the future land use designation to "MDR" Medium Density Residential for a <br />4.2 acre, more or less, portion of the Project Site (as described in Exhibit "A -1 ") currently <br />designated "C" Commercial and for a 5.64 acre, more or less, portion of the Project Site (as <br />described in Exhibit "A -2 ") currently designated "VLDR" Very Low Density Residential. <br />SECTION 2. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to change the zoning to "PDD" Planned Development <br />District with base zoning of "MF -12" Multiple - Family Residential District for a 28.15 acre, more <br />or less, portion of the Project Site (as described in Exhibits "A -2" and "A -3 ") currently zoned <br />"FD" Future Development District, a 0.651 acre, more or less, portion of Project Site (as <br />described in Exhibit "A -4 ") currently zoned "CC" Community Commercial District and the <br />remainder of the Project Site. <br />SECTION 3. The Planned Development District Standards for the Planned <br />Development District, attached to this ordinance as Exhibit `B," and made a part hereof (the <br />"Regulations "), are approved and adopted to regulate the development of the Project Site. The <br />Project Site will be bound by the provisions of the Regulations as though they were conditions, <br />restrictions and limitations on the use of the Project Site under the City's zoning ordinances. <br />Any person, firm, corporation or other entity violating any provisions of the Regulations shall be <br />subject to all penalties that apply to violations of the zoning ordinances of the City of San <br />Marcos, as amended. Any person, firm, corporation or other entity violating any provisions of <br />the Regulations shall be subject to a suit by the City for an injunction to enjoin the violation as <br />though the Regulations were conditions, restrictions and limitations on the use of the Project Site <br />under the City's zoning ordinances. <br />
