tree species should be selected for tolerance to polluted and drought conditions, disease <br />and pest resistance, biodiversity, and visibility. Any street trees provided shall be <br />maintained by the property owner and must be replaced if dead or diseased. Where <br />feasible, the property owner shall provide for seating benches and trash receptacles <br />along River Road. Entrance drives should align with focal points in a development such <br />as landmark towers or landscape features. <br />Project and Project Site are subject to the Concept Plan and Detailed Illustrative <br />Conceptual Plan. <br />6.07 Participation in ACT Ally Program Required <br />The Project Site owner shall participate in the City of San Marcos Achieving Community <br />Together (ACT) program and the requirements thereof. <br />6.08 Occupancy Restrictions <br />Occupancy of all units within this development shall be restricted to a maximum of one <br />person per lease per bedroom. These occupancy restrictions shall not be applicable to <br />families as defined in the City's LDC. <br />6.09 Tree Preservation & Mitigation Requirements <br />The Project Site is subject to the Tree and Habitat Protection requirements of the City's <br />LDC. Any trees that are removed or damaged during development of the Project Site <br />shall be mitigated on the Project Site as follows: <br />Tree Classification <br />Mitigation Ratio <br />Exempt Trees (per Section 5.5.2.1 b <br />N/A <br />Trees less than 9" caliper <br />N/A <br />Trees within Building Footprint, within 10 <br />feet of the Building Footprint or within Site <br />Access Areas <br />In accordance with <br />requirements of <br />Section 5.5.2.2(g) <br />Protected Trees <br />1:1 caliper inch <br />S ecimen Trees <br />2:1 caliper inch <br />To the greatest extent possible, the site layout and building locations on the Project Site <br />shall avoid removal of preferred trees, especially specimen trees. The preservation of <br />existing protected and specimen trees on the Project Site shall count toward mitigation <br />requirements identified of this section. In the event that a tree designated for protection <br />and preserved in accordance with this section dies within 3 years of issuance of <br />certificates of occupancy on the Project Site, loss of such tree tree shall be mitigated in <br />accordance with this section. <br />6.10 Lighting Requirements <br />The Project will provide lighting levels in conformance with LDC requirements and that <br />are compatible with safety and industry standards. <br />12 <br />
