<br /> 7~ ¡::: <br /> This sha 11 include, but not be limited to, the amounts of judgements, <br /> penalties, interests, court costs, legal fees, and all other expenses incurred <br /> by the Owner because of such act, omission, conduct, or activity. <br /> This indemnity provision sha 11 not be 1 imited by reason of the <br /> specification of any particular insurance coverage in this agreement. <br /> Consu ltant further agrees to obtain from its contractors, subcontractors and <br /> consultants, if any, the same indemnification provision in writing with respect <br /> to Owner as stated hereinabove. <br /> 7.4 The Owner hereby agrees, to the fullest extent allowed by law, to <br /> indemnify, defend and hold harmless the Consultant, its affiliates, and their <br /> respective officers, employees, agents and subcontractors from and against all <br /> claims and actions, losses and liabilities including all expenses and attorneys <br /> fees, incidental to any claim or action, based on, or arising out of, damages <br /> ~ <br /> or injuries to persons or property caused by, or arising out of, any hazardous <br /> and/or toxic substances present at the site where the Consultant and/or its <br /> subcontractors have performed work, except if such loss, damage or injuries <br /> were caused or alleged to be caused by the negligence or willful misconduct of <br /> the Consultant, its employees, agents or subcontractors. <br /> 7.5 The Consu ltant agrees to procure and maintain at Consultant's expense <br /> , <br /> until final payment by the Owner for services covered by this Agreement, <br /> insurance in the kinds and amounts hereinafter provided with insurance <br /> companies authorized to do business in the State of Texas, covering all <br /> operations under this Agreement, whether performed by Consultant or <br /> Consultant's agents or employees.
