<br /> C¡oA <br />Network Computing Corporation <br /> <br />(B) "Licensed Materials" - shall mean documentation and materials related to the Licensed Software <br /> including but not limited to flowcharts, sample runs, operations description, user manuals, and sales <br /> literature. <br />(C) "Designated Equipment" - shall mean the Central Processing Unit (CPU class) on which the Licensed <br /> Software is licensed to operate, which is set forth in Exhibit B. Replacement of the Designated <br /> Equipment may result in a change of CPU class and increased license fees and/or increased <br /> maintenance. <br />(D) "Updates" - shall mean any changes made by NCC or at its request to the Licensed Software or <br /> Licensed Materials to correct known defects and maintain the operational quality of the Licensed <br /> Software. <br />(E) "Modifications" - shall mean any changes to any program or part thereof made by NCC or at its <br /> request to the Licensed Software or Licensed Materials, subsequent to the execution of the original <br /> License Agreement between the parties hereto, involving specific defined features or functions for the <br /> Client. These may be slight variations of features or functions of the Licensed Software or added <br /> features or functions. Modifications are provided at the sole discretion of NCC and may be separately <br /> priced from the Licensed Software and Licensed Materials. <br />(F) "Enhancements" - shall mean any changes made by NCC or at its request to the Licensed Software <br /> or Licensed Materials subsequent to the execution of the original License Agreement between the <br /> parties hereto that NCC makes generally available to its customer base. Enhancements are provided <br /> at the sole discretion of NCC and may be separately priced from the Licensèd Software and Licensed <br /> Materials. <br />(G) "Release" - shall mean a revision to the Licensed Software which encompasses any Updates, <br /> Modifications or Enhancements which NCC, in its sole discretion, chooses to include in the Release <br /> and which is made generally available to Clients by NCC without separate pricing. <br />(H) "Third Party Software" - shall mean any software furnished by NCC to the Client including but not <br /> limited to the operating system software, support utilities, report writers and productivity aids for <br /> operation on the Designated Equipment which is not part of NCC's proprietary Licensed Software as <br /> evidenced by a separate license agreement(s) with the appropriate vendor. <br />(I) "Operating System" - shall include but not be limited to the operating system, utility programs, <br /> security systems, data communications features, data base management capabilities, routines, optional <br /> or mandatory feature releases, and any related documentation or media. <br />(J) "System" - The entire computer system ("System") is defined as the Licensed Software, as well as the <br /> Operating System and all the computer equipment Client purchased from NCC, or with NCC's <br /> guidance which equipment is described in Exhibit B to this Agreement ("Equipment"). <br />(K) "Computer Software" - shall mean the Licensed Software and Operating System. <br />(L) "Error Category" - shall mean the classification ascribed to each defect or bug identified within the <br /> Licensed Software as set forth in Exhibit D and/or E below. <br /> 2 <br />
