appeal. A final decision on the appeal will be made within thirty days of receipt of the appeal <br />and a written response sent to the applicant. <br />(3) Appeals not submitted in accordance with these guidelines will be dismissed and may not be <br />re- filed. <br />Project Length - Projects must be completed and all requirements of the RLF contract (except for the <br />qualified exception of complete loan repayment which may be structured for longer than three years) must <br />have been met within one year from the execution date of the RLF contract agreement. One extension <br />may be granted by the City Manager if there are extenuating circumstances to justify the extension. <br />Records Retention — The business shall maintain all books, documents, papers, accounting records, other <br />records and other evidence directly pertaining to the RLF loan. Documentation includes source documentation <br />such as cancelled checks, paid bills, payrolls, time and attendance records, and loan documents. Records must <br />be maintained during the contract period and for four (4) years after receipt of final payment. <br />The business shall grant access at no expense to the City of San Marcos, the Texas Department of Agriculture, <br />the Comptroller General of the United States or any of their duly authorized representatives to any books, <br />documents, records, and papers of the contractor which are directly pertinent to that specific contract for the <br />purpose of making audits, examinations, excerpts and transcriptions. <br />Relocating Projects - RLF funds may not be used for any activity that would assist directly the relocation <br />of any industrial or commercial plant, facility, or operation, from one area to another area, if the relocation is <br />likely to result in a significant loss of employment in the labor market area from which the relocation occurs, <br />as per the anti - pirating provisions found at 24 CFR 570.210. <br />Scoring Criteria - applicant must receive at least 60 points out of a possible 100 points to be considered for <br />funding. Refer to the selection criteria (under selection procedures below). <br />Selection Procedures- Revolving Loan F u n d Program applications are submitted to the Development <br />Services — Planning office for review and scoring. The review process consists of the following steps: <br />(1). Upon receipt of an application, the City will perform an initial review to determine whether the <br />application is complete and whether the activities proposed are eligible for funding. In those <br />instances where the City determines that the application is either incomplete or that the <br />activities are ineligible for funding, the application is returned to the applicant to complete and/or <br />revise. <br />(2). The City will then conduct a review of each complete application to make threshold <br />determinations with respect to: <br />(A) the financial feasibility of the business to be assisted based on a credit analysis; <br />(B) the strength of commitments from all other public and /or private investments identified in <br />the application; <br />(C) whether the use of Revolving Loan Funds is appropriate, as defined below, to carry out <br />the project proposed in the application. <br />i. the business can raise only a portion of the debt and equity funds necessary to <br />complete the project. A gap between sources and uses exists and Revolving <br />Loan Funds fill the gap; <br />ii. the business cannot raise any portion of the debt necessary to complete the <br />10 <br />
