ORDINANCE 1993- 77 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING 31.8 ACRES, <br />MORE OR LESS, OF LAND AREA IN THE J.M. <br />VERAMENDI LEAGUE SURVEY NO. ONE, CITY OF SAN <br />MARCOS, HAYS COUNTY, TEXAS, LOCATED ALONG THE <br />SOUTHWEST SIDE OF THE 1300 BLOCK OF WONDER <br />WORLD DRIVE FROM "PD" PREDEVELOPMENT DISTRICT <br />TO "MF-5" MULTIFAMILY DISTRICT (HIGH DENSITY) <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on June 29, 1993, the Zoning commission of the City <br />of San Marcos held a public hearing regarding a request to change <br />the zoning from "PD" Predevelopment District to "MF-5" Multifamily <br />District (high density) for 31.8 acres, more or less, of land area <br />in the J.M.Veramendi League Survey No. One, city of San Marcos, <br />Hays County, Texas, located along the southwest side of the 1300 <br />block of Wonder World Drive; and, <br /> <br />WHEREAS, subsequent to the public hearing on that date, the <br />Commission did, on June 29, 1993 consider the request and voted to <br />approve it and has recommended that the request be approved by the <br />City Council of the City; and, ~ <br /> <br />WHEREAS, the City Council held a public hearing on the 27th <br />day of September, 1993, regarding the request; and, <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the city of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, the city Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the <br />public health, morals, welfare and $afety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as <br />described in section 3 of the General zoning Ordinance, is hereby <br />amended to rezone the following described real property located <br />along the southwest side of the 1300 block of Wonder World Drive, <br />San Marcos, Hays County, Texas, which is presently zoned "PD" <br />Predevelopment District to "MF-5" Multifamily District (high <br />density) : <br /> <br />DESCRIPTION OF 31.8 ACRES, MORE OR LESS, OF LAND AREA IN <br />THE J.M. VERAMENDI SURVEY NO. ONE, CITY OF SAN MARCOS, <br />HAYS COUNTY, TEXAS, BEING A PORTION OF THAT TRACT <br />DESCRIBED AS 116.94 ACRES IN A DEED FROM H.L. SCHULLE TO <br />MARY ANNE HOOD, TRUSTEE DATED NOVEMBER 9, 1973 , AND <br />RECORDED IN VOLUME 263, PAGE 522 OF THE HAYS COUNTY DEED <br />RECORDS, AND BEING MORE PARTICULARLY DESCRIBED BY METES <br />AND BOUNDS AS FOLLOWS: <br /> <br />BEGINNING at an iron rod in fence in the northeast line <br />of that tract described as 166.670 acres in a deed from <br />T-D Investments to M R Properties dated April 29, 1987 <br />and recorded in Volume 670, Page 497 of the Hays County <br />Real Property Records for the west corner of Lot 1, <br />Jackson Chapel Addition as recorded in Volume 6, Page 14 <br />of the Hays County Plat Records, for the south corner of <br />this tract and for the south corner of that 100 foot wide <br />electric line easement and right-of-way granted from Mary <br />Anne Hood to the Lower Colorado River Authority dated <br />June 20, 1986, and recorded in Volume 638, Page 713 of <br />the Hays County Real Property Records; <br /> <br />THENCE leaving Lot 1, Jackson Chapel Addition with the <br />
