21.Consider approval of Resolution 2013 -31R, directing publication of Notice of Intention to issue Certificates of Obligation; and other matters related thereto. 22.Consider approval of Resolution 2013 -32R, expressing the City's official intent to reimburse the costs of acquiring an ownership interest in the Thomas C. Ferguson Replacement Power Plant with the proceeds of future debt instruments in an aggregate Principal amount not to exceed $18,000,000.00 and declari an effecti ng ve date. MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member Scott, the City Council voted seven (7) for and none (0) opposed, to approve the consent agenda with the exception of 19, 21, and 22 which were considered separately. The motion carried unanimously. (19) MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve Resolution 2013 -29R, as previously captioned. The motion carried unanimously. (21)MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve Resolution 2013 -31R by authorizing the issuance of Certificates of Obligation in an amount not to exceed $18,000,000. The motion carried unanimously. (22) MOTION: Upon a motion made by Council Member Thomaides and a second by Council Member Scott, the City Council voted seven (7) for and none (0) opposed, to approve Resolution 2013 -32R, as previously captioned. The motion carried unanimously. Public Hearing 23. PM Receive a Staff presentation and hold a Public Hearing to recei 00 ve comments for or against Ordinance 2013 -09, amending Chapter 1, Article 4, Division 4 of the City's Land Development Code to allow the City Council to waive zoning regulations as an economic development incentive; providing a savings clause; providing for the repeal of any conflicting provisions; and providing an effective date; and consider approval of Ordinance 2013 -09, on the first of two readings. Matthew Lewis, Director of Development Services, provided a brief presentation. Mayor Daniel Guerrero opened the public hearing at 7:31 p.m. Dianne Wassenich, 11 Tanglewood, spoke against the ordinance, and that she would like to keep the public notice requirement. Thom Prentice, San Marcos, spoke against the ordinance. Melissa Derrick, San Marcos, spoke against the ordinance.
