21.Consider approval of Resolution 2013 -31R, directing publication of Notice of Intention <br />to issue Certificates of Obligation; and other matters related thereto. <br />22.Consider approval of Resolution 2013 -32R, expressing the City's official intent to <br />reimburse the costs of acquiring an ownership interest in the Thomas C. Ferguson <br />Replacement Power Plant with the proceeds of future debt instruments in an aggregate <br />Principal amount not to exceed $18,000,000.00 and declari an effecti <br />ng ve date. <br />MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Scott, the City Council voted seven (7) for and none (0) opposed, to approve the <br />consent agenda with the exception of 19, 21, and 22 which were considered separately. The <br />motion carried unanimously. <br />(19) MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2013 -29R, as previously captioned. The motion carried unanimously. <br />(21)MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2013 -31R by authorizing the issuance of Certificates of Obligation in an amount not <br />to exceed $18,000,000. The motion carried unanimously. <br />Public Hearing <br />23. PM Receive a Staff presentation and hold a Public Hearing to recei <br />00 ve comments for <br />or against Ordinance 2013 -09, amending Chapter 1, Article 4, Division 4 of the City's <br />Land Development Code to allow the City Council to waive zoning regulations as an <br />economic development incentive; providing a savings clause; providing for the repeal of <br />any conflicting provisions; and providing an effective date; and consider approval of <br />Ordinance 2013 -09, on the first of two readings. <br />Matthew Lewis, Director of Development Services, provided a brief presentation. <br />Mayor Daniel Guerrero opened the public hearing at 7:31 p.m. <br />Dianne Wassenich, 11 Tanglewood, spoke against the ordinance, and that she would like to keep <br />the public notice requirement. <br />Thom Prentice, San Marcos, spoke against the ordinance. <br />Melissa Derrick, San Marcos, spoke against the ordinance. <br />
