Non Consent Agenda <br />25.Consider approval of Ordinance 2013 -11, amending Chapter 2, Article 3 Boards, <br />Committees and Commissions, Division 18 Animal Shelter Advisory Committee, on the <br />first of two readings, by amending Section 2.366 of the San Marcos City Code to add the <br />City of Buda as a member of the Animal Shelter Advisory Committee; including <br />procedural provisions; and providin an effecti <br />g ve date. <br />MOTION: Upon a motion made by Council Member Scott, and a second by Council Member <br />Becak, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2013- <br />1 1 on the first of two readings, as previously captioned. The motion carried unanimously. <br />26.Consider approval Ordinance 2013 -12, on the first of two readings, amending Section <br />2.211 of the San Marcos City Code to change the composition of the Main Street <br />Advisory Board from fifteen members to nine members; including procedural <br />provisions; and providing an effective date. <br />MOTION: Upon a motion made by Council Member Becak and a second by Council Member <br />Scott, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2013 -12, <br />on the first of two readings, as previously captioned. The motion carried. <br />27.Consider an appeal of Conditional Use Permit (CUP- 12 -42) issued to Zelicks Inc. on <br />December 11, 20120 <br />MOTION TO AMEND CUP: Upon a motion made by Council Member Becak and a second <br />by Council Member Scott, the City Council voted three (3) for and four (4) opposed, Council <br />Members Prather, Thomaides, Thomason and Mayor Guerrero, to amend the CUP by allowing <br />no live outdoor amplified music unless mutually agreed upon by both parties, the Katz's and <br />Dillon's, motion to amend failed. MOTION TO AMEND CUP: Upon a motion made by <br />Council Member Thomason and a second by Council Member Prather, the City Council voted <br />two (2) for and five (5) opposed, Council Members Scott, Thomaides, Porterfield, Becak and <br />Mayor Guerrero, to amend by allowing live outdoor amplified music 18 days per calendar year, <br />with the understanding that Zelicks must (in writing) notify Crystal River Inn 30 days prior to an <br />event and Crystal River Inn must provide a wedding schedule to Zelicks. The motion to amend <br />failed. MOTION TO SUSPEND RULES: Upon a motion made by Council Member Porterfield <br />and a second by Mayor Guerrero, the City Council voted seven (7) for and none (0) opposed, to <br />suspend the rules. The motion carried unanimously. MOTION TO AMEND CUP: Upon a <br />motion made by Mayor Guerrero and a second by Council Member Becak, the City Council <br />voted five (5) for and (2) opposed, Council Members Prather and Thomason that no live outdoor <br />amplified music shall be allowed. The motion carried. <br />28.Receive a presentation and hold discussion regarding the Gas Lamp Public <br />Improvement District Project request, and provide direction to Staff. <br />Matthew Lewis, Director of Development Services and Steve Parker, Assistant City Manager <br />provided a presentation regarding the Gas Lamp PID Project and the Walton Group's request. <br />
