<br />98 <br /> <br />regular meeting <br /> <br />february 23, 1981 <br /> <br />page two <br /> <br />Mrs. Norris moved to adopt the Ordinance on third and final reading. Mr. <br />Stokes seconded the motion. Mr. Brown had a question concerning the right- <br />of-way. Mr. Krauskopf, agent for the applicant, stated that there was a <br />problem with the survey of the property, but that the owner was willing to <br />give the right-of-way after the survey was complete. Mr. James asked if <br />the problem of right-of-way could be taken care of when the owner applied <br />for a building permit. The City Manager stated yes, but problems still <br />could arise. Mr. Krauskopf stated that this seemed like a question of <br />conditional zoning. Mr. Brown then moved to table the third and final <br />reading of this Orldinance. Mrs. Norris seconded the motion. On roll <br />call, the following vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Cavazos, James, Norris, Stokes, Tarbutton <br /> <br />NAY: <br /> <br />None <br /> <br />ABS'I'AIN: <br /> <br />Kraus <br /> <br />The Mayor introduced for consideration an Ordinance on third and final <br />reading, the caption of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE OZNING OF 1 ACRE OUT OF THE A.N. <br />WITHERS SUBURBAN SUBDIVISION, LOCATED AT THE CORNER OF RANCH ROAD <br />12 AND BISHOP ST., FROM "R-l" (SINGLE F.AMILY RESIDENTIAL) TO "c" <br />(COMMERC IAL) . <br /> <br />The City Manager stated that the question of traffic had been addressed. <br />Mr. James moved to adopt the Ordinance on third and final reading. Mrs. <br />Norris seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration an Ordinance on third and final <br />reading, the caption of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING RATE SCHEDULES TO BE CHARGED BY LOWER COLORADO RIVER <br />AUTHORITY IN THE CITY OF SAN MARCOS, TEXAS, PROVIDING FOR AN EFFECTIVE <br />DATE FOR SUCH RATE SCHEDULES, PROVIDING CONDITIONS UNDER WHICH SUCH <br />RATE SCHEDULES MAY BE CHANGED, MODIFIED, AMENDED OR WITHDRAWN AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mrs. Norris moved to adopt the Ordinance on third and final reading. <br />Brown seconded the motion, which passed unanimously. <br /> <br />Mr. <br /> <br />The Mayor introduced for consideration an Ordinance on second reading, the <br />caption of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 2.907 ACRES OUT OF THE <br />CHARLES DAVIS TRACT, LOCATED ON LBJ DRIVE, FROM "R-2" (DUPLEX DWELLING <br />DISTRICT) TO "D" (MULTI-FAMILY DWELLING DISTRICT). <br /> <br />Mrs. Norris moved to approve the Ordinance on second reading. Mr. James <br />seconded the motion.
