MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Thomason, MOTION TO AMEND: Upon a motion made by Council Member <br />Porterfield and a second by Council Member Prather, the City Council voted seven (7) for and <br />none (0) opposed, to amend Section 6.13 by adding that the applicant provide adequate private <br />shuttle service to residents until Texas State University is able to provide transportation service <br />to the site. The motion carried. MOTION TO AMENDA: Upon a motion made by Council <br />Member Scott and a second by Council Member Porterfield, the City Council voted six (6) for <br />and one (1) opposed, Council Member Thomaides, to amend the PDD by including the right of <br />first refusal for a period of one year regarding 31.25 acres of land south of the San Marcos River. <br />The motion carried. MAIN MOTION: the City Council voted (5) for and (2) opposed, Council <br />Member Prather and Council Member Thomaides to approve Ordinance 2013 -03, as amended. <br />The motion carried. <br />Non Consent Agenda <br />18.Consider approval of Ordinance 2013 -04, on the first of two readings, adopting fees -in- <br />lieu of preserving Protected and Heritage Trees for SmartCode Projects at the rate of <br />$150 per caliper inch for Protected Trees and at the rate of $300 per caliper inch for <br />Heritage Trees; restating Zoning Review Fees, Subdivision Review Fees, Site Fees, <br />Licensing Fees and Building Fees previously adopted by Ordinance No. 2012 -35 and <br />Ordinance No. 2012 -38; providing a savings clause; providing for the repeal of any <br />conflicting provisions; and providing an effective date. <br />MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Prather, the City Council voted seven (7) for, and none (0) opposed, to postpone Item <br />16 to a future meeting. The motion carried. <br />19.Consider approval of Resolution 2013 -06R adopting a policy that establishes guidelines <br />and criteria governing Tax Abatement Agreements; and declaring an effective date. <br />MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Prather, the City Council voted seven (7) for, and none (0) opposed, to postpone Item <br />16 to a future meeting. The motion carried. <br />20.Discuss and consider nominations and charge to the 2013 Charter Review Commission, <br />and provide direction to Staff. <br />Council Members made their nominations to the Charter Review: <br />Mayor Guerrero: Jane Hughson; Council Member Thomaides: Scott Gregson; Council Member <br />Thomason: Kathy Morris; Council Member Scott: Mike Narvaiz; Council Member Porterfield: <br />None at this time; Council Member Prather: Melissa Derrick; Council Member Becak: Dwayne <br />Thomason. The Council discussed recommending the following items for review during the <br />upcoming Charter review session: 1) Rezoning cases having an actual second reading instead of <br />reconsideration; 2) The land ownership requirement for Planning and Zoning Commission <br />members; 3) Term Limits for Mayor and Council Members 4) Election Cycle (holding an <br />election every other year instead of annually). <br />
