UPDATES <br /> Heron, Inc. shall use its best efforts, subject to the limitations <br /> described in Section 6 below, to furnish Client with updates to the <br /> Licensed Software that are necessitated by changes to the Computer <br /> System and the Client VMS operating environments. <br /> In the event that Client requires modifications to the Licensed <br /> Software or consultancy services from Heron, Inc. to integrate the <br /> Licensed Software with other software and hardware that Client may <br /> possess, Client may obtain Heron, Inc. 's consultancy services at <br /> Heron, Inc. prevailing rates at the time. <br /> 6. NEW RELEASES <br /> (A) Method of Issuance: From time to time, Heron, Inc. will issue <br /> to Client new releases to Client's software system. Heron, <br /> Inc. will notify Client of expected date of IJ.ew release to <br /> allow appropriate planning for installations, conversions and <br /> testing. Heron, Inc. will provide such new releases to Client <br /> in person, by mail or via telecommunications (if available) at <br /> Heron, Inc. 's option at no additional cost to Client. <br /> (B) Timely Installation: Should support be requi~€d by Client to <br /> install a new release previously provided by Heron, Inc., such <br /> support will be provided under the level of maintenance <br /> service selected. <br /> (C) Supporting Documentation: Heron, Inc. agrees to provide to <br /> Client user documentation necessary for Client's successful <br /> operation of the new release. <br /> (D) Fees: New Releases will be provided by Heron, Inc. at no <br /> - charge if Heron, Inc.' s Software Maintenance Agreement is in <br /> effect. If Heron, Inc. is requ¡=sted to install a new release <br /> Heron, Inc. will only charge for additional <br /> programming/testing services necessary to integrate customer <br /> modifications unique to Client. <br /> 7. RDB/VMS INSTALLATION ASSISTANCE <br /> Heron, Inc. shall use its best efforts to provide the technical <br /> resources required to assist the Client in installing a new release <br /> of the Roo database, at no additional cost to Client. This <br /> installation service may require that the customer load the newest <br /> release of the Licensed Software and may be timed to coincide with <br /> a new release of Application software as the installation of Roo <br /> may necessitate changes to the Application software. Heron, Inc. <br /> shall make the changes to the Application software on their release <br /> schedule. Upon notification from DEC of a new release, Heron, Inc. <br /> will test the release at Heron, Inc., determine if the benefits of <br /> the new release are significant to improving overall Licensed <br /> 11 <br />
