<br /> (5) All other regulatory signs where the authority to <br /> install is not specifically delegated to the traffic <br /> engineer in subsection (b). <br /> (b) The city traffic engineer shall have the authority to <br /> install the following traffic control devices: <br /> ( I) Stop signs, yield signs and multi-way stop signs and <br /> signals¡ <br /> (2) Parking restrictions delegated to the traffic <br /> engineer as set out under this Chapter¡ <br /> (3) Prohibited turns or lane uses; <br /> (4) Crosswalks ¡ <br /> (5) Traffic lanes and pavement markings; <br /> (6) Loading zones or bus stop zones¡ and <br /> (7) Truck routes through the City. <br /> Sec. 29-4. Traffic register. <br /> The traffic engineer shall develop and maintain a traffic <br /> register containing a record of every location in the city <br /> where any traffic control device or special regulation is <br /> made applicable whether by ordinance or by the traffic <br /> engineer's authority established under this Chapter. The <br /> traffic register shall be continuously maintained by the <br /> traffic engineer and all persons shall be charged with notice <br /> of its contents. Defects, omissions or entries of the <br /> traffic register shall not constitute a defense to <br /> prosecution for traffic law violations. Whenever any traffic <br /> control device or special regulation no longer applies in the <br /> city, the record of the location shall remain in the traffic <br /> register, but shall be prominently marked "DELETED" by the <br /> traffic engineer who shall also note the date of the deletion <br /> and the authority therefor. <br /> Sec. 29-5. Traffic control devices - conformity with manual. <br /> All traffic-control signs, signals and other devices shall <br /> conform to applicable provisions of the current sta te Manual <br /> on Uniform Traffic Control Devices. <br /> Sec. 29-6. Proper placement for enforcement: sections effective <br /> where no signs required. <br /> No provision of this Chapter for which signs or markings are <br /> required shall be enforced if at the time and place of the <br /> alleged violation an official sign or marking is not in <br /> proper position and sufficiently visible to be seen by an <br /> ordinarily observant person. Whenever a particular section <br /> of this chapter does not state that signs or marking s are <br /> required, the section shall be effective even though no signs <br /> or markings are erected or put in place. <br /> Sec. 29-7. Proof of official installation. <br /> (a) In any prosecution for a violation of this Chapter, proof <br /> that any traffic control device was actually in place at <br /> a location at the time of the violation shall constitute <br /> prima facie evidence that it was officially installed <br /> under proper authority of the traffic engineer or the <br /> city council. <br /> (b) A person charged with a violation of this Chapter may <br /> introduce evidence to show that the sign, signal or <br /> -2- <br />
