vffiEREAS, the City Council held a public hearing on January 13 , 199~, regarding all of these amendments; and, WHEREAS, the City Council hereby finds and determines that the adoption of the following amendments is in the interest of the public health, morals, ~..¡el fare, and safety; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 2(A)(3) of Appendix A, General Zoning Ordinance, of the San Marcos Code of Ordinances is amended with regard to notification of owners of property within 2ØØ feet of a proposed zoning classification change to read as follows: (3) Nritten notice of all public hearings on proposed changes in classifications shall be sent to all owners of property, or to the person rendering the property for City taxes, affected by such proposed changes in classifications, and to all owners of property, or to the person rendering the property for City taxes, located within 2ØØ feet of any property affected before the lØth day before the hear ing date. Such notice may be served by depositing the same, properly addressed and postage-prepaid, in the City post office. ~"There property lying within 2ØØ feet of the property proposed to be changed is located in territory which was annexed into the City after the final date of making the renditions \.¡hich are included on the last approved City tax roll, notice to such owners shall be given by publication in the manner provided by this paragraph 3. SECTION 2. That definition (32) for the Director of Planning, in Section 4 of Appendix A, General Zoning Ordinance, of the San Marcos Code of Ordinances is amended to read as follows: (32) Director: Director of the Planning and Development Services Department of the City. SECTION 3. That a definition for Kennel be added as nwnber (53) of Section 4 of Appendix A, General Zoning Ordinance, of the San Marcos Code of Ordinances to read as follows: (53) Kenne1: An establishment in which domesticated animals are housed, groomed, bred, boarded, or trained for a fee. SECTION 4. That definitions (lØØ), Tourist court and (lØ3), Used car lot, of Appendix A, General Zoning Ordinance of the San Marcos Code of Ordinances be deleted in their entirety. SECTION 5. That the terms "Director of Planning" and "Planning Director" are changed to read "Director" throughout Appendix A, General Zoning Ordinance, of the San Marcos Code of Ordinances.
