<br /> SECTION 6. That Section 5(B), New Districts, of <br />Appendix A, General Zoning Ordinance of the San Marcos Code <br />of Ordinances be amended to delete "Op" Office and <br />Professional District designation from, and to add "LB" <br />Limited Business District designation to, the list of New <br />Districts. <br /> SECTION 7. That the first paragraph and subsection (A) <br />of Section 25, "M" Single- family, Duplex, and Neighborhood <br />Business District, be amended regarding the issuance of site <br />development and building permits and to add and delete <br />certain permitted uses in the "M" District to read as <br />follows: <br /> This classification is to be phased out. No building <br /> permit or site development permit shall be issued for <br /> new construction of principal buildings located on any <br /> property zoned "M" until an application is submitted to <br /> the Department of Planning and Development Services to <br /> change the zoning classification in conformance with <br /> this ordinance and the City.s Master Plan. However, <br /> permits may be issued for remodeling and repair of <br /> existing principal buildings, or for new construction of <br /> accessory buildings, for uses that are listed as <br /> permitted in this district without applying for a zoning <br /> change. If the use is not listed herein as permitted in <br /> the M district, the issuance of permits shall be further <br /> withheld until the property is officially rezoned to a <br /> district which would permit the use. <br /> (A) Permitted uses: <br /> ( 1) Single-family detached dwelling. <br /> (2) Duplex. <br /> (3) Neighborhood businesses including the <br /> following: Antique shops, art galleries, <br /> convenience grocery stores not having vehicle <br /> fuel pump facilities, drug stores, variety <br /> stores, bakeries, shoe repair shops, flower <br /> shops, book and stationery stores, tailors, <br /> dressmakers, barber and beauty shops, <br /> cleaners, and delicatessens or restaurants <br /> with no more than 35Ø square feet of dining <br /> area and which do not dispense alcoholic <br /> beverages for on-premise consumption. <br /> Neighborhood businesses shall be limited to <br /> those requiring no more than five off-street <br /> parking spaces according to standard s <br /> contained in Section 37. <br /> (4) Professional offices. <br /> (5) Churches <br /> (6) Day care centers. <br /> ( 7) Clinics, excluding institutions for the care <br /> of the mentally ill or alcohol or narcotic <br /> addicts, and excluding veterinary services. <br /> (8) Convalescent homes and nursing homes. <br /> (9) Group homes. <br /> SECTION 8.
