To qualify under job creation or retention, there <br /> must be clear evidence which demonstrates the jobs to be created or retained can only <br /> be attained because of the RLF assistance. <br /> Legal ReQuirements <br /> <br /> Any program income that the state has permitted the unit of general local government to retain <br /> in a CDBG funded program is subject to the requirements of the Housing and Community <br /> Development Act and the regulations at 24 CFR 570, Subpart I. We will not monitor for <br /> compliance the use of program income generated by grants which are closed-out and where <br /> the Contractor does not have another open CDBG contract. If a problem occurs, however, and <br /> is brought to our attention, we reserve the right to intervene at that time. <br /> All activities must be performed in accordance with the terms of the applicable laws and <br /> regulations outlined in Exhibit A, and the certifications outlined in Exhibit B. <br /> Regarding procurement under the revolving loan fund, communities must comply with all <br /> applicable federal, state, and local laws, regulations, and ordinances. <br /> Section 109 of Public Law 100-202 restricts awarding contracts for work on public buildings or <br /> public works to contractors or sub-contractors from foreign countries that deny fair trade <br /> practices to the United States. <br /> Any alterations, additions, or deletions to the terms of this fund which are required by changes <br /> in federal or state law or regulations are automatically incorporated into this revolving loan <br /> fund without written amendment hereto, and shall become effective on the date designated by <br /> such law or regulation. <br /> Environmental Clearance Requirements <br /> <br /> Communities will be responsible fC?r environmental review, decision making, and other actions <br /> which would otherwise apply to the Department under Section 5304(1) of the Act, in accordance <br /> with and to the extent specified in 24 C.F.R. Part 58. In accordance with Section 58.77(b) of <br /> such regulations, Communities must handle inquiries and complaints from persons and <br /> agencies seeking redress in relation to environmental reviews covered by approved <br /> certifi cations. <br /> Funds provided under this revolving loan fund may be obligated and expended before the <br /> actions specified in this Section occur only for the following eligible activities: <br /> 1. The payment of reasonable planning and administrative costs related to the project. <br /> 2. Environmental studies, including environmental clearance activities required by this <br /> Section; and <br /> 3. The payment or reimbursement of reasonable project engineering and design costs <br /> incurred for this project. <br /> - 8 - <br />
