<br /> The United States Department of Housing and Urban Development, the Inspector General, the <br /> Comptroller General of the United States, the Auditor of the State of Texas, and Department, <br /> or any of their duly authorized representatives, will be. granted access to and the right to <br /> examine all books, belonging to or in use by the community pertaining to its RLF. Such rights, <br /> to access shall continue as long as the records are retained by the community. Communities <br /> agree to maintain such records in an accessible location. <br /> Communities must include the substance of this Section in all agreements with recipients. <br /> Conflict of Interest <br /> City/county understands that neither it nor any member of its governing body may have any <br /> interest or will acquire any interest, direct or indirect, in the business assisted with these funds <br /> which would conflict in any manner or degree with performance of this RLF. They further <br /> understand that in performance of this RLF, no person having such interest shall be employed <br /> or appointed by them. <br /> The city/county will guarantee that no employee, officer, or agent of theirs will participate in the <br /> selection, or in the award or administration of a recipient agreement supported by funds <br /> provided under these guidelines if a conflict of interest, real or apparent, would be involved. <br /> Such conflict of interest would arise when: 1} the employee, officer, or agent; 2} any member <br /> of his or her immediate family; 3) his or her partner; or, 4) any organization which employs, or <br /> is about to employ any of the above, has a financial or other interest in the firm or person <br /> selected to perform the duties associated with receipt of revolving loan funds. <br /> City/County employees, officers, and/or agents will neither solicit nor accept gratuities, favors, <br /> or anything of monetary value from recipients or potential recipients of revolving loan funds. <br /> Sectarian Activity <br /> <br /> None of the performances rendered by communities under this RLF will involve, and no portion <br /> of the funds received by them under this fund, will be used in support of any sectarian or <br /> religious activity, nor win any facilities used in the performance of this RLF be used for sectarian <br /> instruction or as a place of religious worship. <br /> Changes and Amendments <br /> <br /> It is understood and agreed by the communities participating in the RLF, that performance <br /> under this RLF must be rendered in accordance with the Act, the regulations promulgated <br /> under the Act, the assurances and certifications made to Department by them, and the <br /> assurances and certifications made to the United States Department of Housing and Urban <br /> Development by the State of Texas with regard to the operation of the Texas Community <br /> Development Program. Based on these considerations, and in order to ensure the legal and <br /> effective performance of this RLF by communities, it is agreed by them that the performances <br /> under this RLF are amended by the provisions of the Texas Community Development Program <br /> (TCDP) Project Implementation Manual and any amendments thereto and may further be <br /> - 11 - <br /> - <br />
