<br /> amended in the following manner: Department may from time to time during the period of <br /> performance for the RLF issue policy directives which serve to establish, interpret, or clarify <br /> performance requirements for these funds. Such policy directives will be promulgated by the <br /> Director of the TCDP in the form of TCDP issuances, will have the effect of qualifying the terms <br /> of this fund and will be binding upon communities. as if written herein, provided however that <br /> said policy directives and any amendments to said Manual shall not alter the terms of this fund <br /> prior to the effective date of sajd amendments or policy directives. <br /> Reporting Requirements <br /> <br /> After the original contract has been closed out, the city/county will submit to the Department <br /> a report which details all recaptured program income and expenditures of this program income <br /> on an annual basis. The city/county will be required to certify that all expenditures of program <br /> income have been in accordance with their approved RLF policy guidelines. Forms for this <br /> report will be provided to the them by the Department. <br /> Other Requirements <br /> <br /> Businesses claiming retained jobs as part of a proposal must provide documentation that the <br /> employees will be permanently laid off or the business will close down or relocate out of state <br /> if RLF monies are not avaiJable. This requirement will apply Ü the Contractor structures its RLF <br /> to allow job retention. <br /> If a firm requires infrastructure improvements such as expanded treatment facilities, the <br /> applicant can only request the minimum amount of RLF funds needed to fund additions or <br /> improvements for that specific business. This requirement will apply tl the contractor structures <br /> its RLF to allow for infrastructure improvements. <br /> The costs of providing infrastructure to benefit a specific business must not exceed the amount <br /> of resources available to the city/county (this means resources other than the RLF). Any <br /> available resources to the city/county must be put in "first", thereby creating a "gap". This <br /> requirement will apply Ü the community structures its RLF to allow for infrastructure <br /> improvements. <br /> tf the RLF is not administered in accordance with the plan submitted and approved by <br /> Commerce, the Department reserves the right to disqualify the city/county for additional TCF <br /> grants. <br /> Any alterations, additions, or deletions to the terms of this fund by the Community require <br /> written approval from the Department. However, the Department understands that the <br /> Community will have certain procedures in use or written procedures which will be used to <br /> implement their approved policy which may change. <br /> Additionally. EXHIBIT A, THE APPLICABLE LAWS AND REGULATIONS. and EXHIBIT B. <br /> CERTIFICATIONS. must be Dart of the adoptAd plan. These exhibits follow on pages 14 <br /> through 16, inclusive. <br /> All of the aforementioned items must be incorporated into each community's RlF if the original <br /> contract provided for one. <br /> - 12 - <br />
