72 RESOLUTION 1992- 32 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE TERMS AND CONDITIONS OF SUPPLEMENTAL AGREEMENT NO. 3 TO LEASE AGREEMENT NO. DTFA07-85-L-0l095 BETWEEN THE CITY OF SAN MARCOS AND THE UNITED STATES OF AMERICA, REPRESENTED BY THE FEDERAL AVIATION ADMINISTRATION: AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY AND TO ACT IN ALL MATTERS RELATED TO THE SUPPLEMENTAL AGREEMENT: AND DECLARING AN EFFECTIVE DATE. WHEREAS, on February 1, 1985, the City of San Marcos entered into Lease No. DTFA07-85-L-0l095 with the United States of America, represented by the Federal Aviation Administration (the "Government") for proj ects at the San Marcos Municipal Airport: and, WHEREAS, the original lease was amended on December 19, 1985 by Supplemental Agreement No.1 and on February 27, 1990 by Supplemental Agreement No.2: and, WHEREAS, the Government is required to construct an access road to the localizer equipment for Runway 12: and, WHEREAS, the Government requires additional land for construction of the access road: and, WHEREAS, the City wishes to provide the additional land: now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That Supplemental Agreement No. 3 a copy of which is attached for all intents and purposes, the terms and conditions of to Lease No. DTFA07-85-L-0l095, hereto and incorporated herein are hereby approved. PART 2. That the City Manager, Larry D. Gilley is authorized to execute Supplemental Agreement No. 3 on behalf of the City and to act in all matters related to Suppl~mental Agreement No.3. PART 3.
