<br />5. SPECIAL PROVISIONS <br /> <br />A. EXCLUSIONS: The following are to be excluded from the Terms <br />and Conditions in Section 3. <br /> <br />l. Paragraph 7 - Late Bids or Modifications <br />2 . Paragraph 9 - Pre-award Survey <br />3. Paragraph 16 - Maintenance Manuals and Parts Catalogs <br />4. Paragraph 25 - Performance Bond <br />5. Paragraph 41 - Order of Precedence <br /> <br />B. LATE BIDS OR MODIFICATIONS: Bids and modifications received <br />after the time set for the bid submission will not be considered. <br /> <br />C. ORDER OF PRECEDENCE: In the event of inconsistency between <br />provisions of this solicitation, the inconsistency shall be <br />resolved by giving precedence in the following order: <br /> <br />1. The Bid Summary Sheet <br /> <br />2. The Specifications <br /> <br />3. The Special Provisions <br /> <br />4. The Terms and Conditions <br /> <br />5. Other provisions, whether incorporated by reference or <br />otherwise. <br /> <br />D. FACTORS OF AWARD: <br />evaluating the bid. <br /> <br />The following criteria shall be used in <br /> <br />1. Price per item. <br /> <br />2. Responsibility of the bidder. <br /> <br />3. Responsiveness of the bid. <br /> <br />E. AWARD OF BID: The City of San Marcos has the right to award <br />the bid on a per item basis. Bidder is not required to bid en each <br />item. <br /> <br />F. REFERENCES: Bidder shall submit three (3) references fer whom <br />it has sold similar goods to, with its bid. The City of San Marcos <br />shall not be used as a reference. <br />
