<br />G. CONTRACTOR EXPERIENCE: Bidder certifies that it is engaged in <br />a full-time business operation for this item and has been for a <br />minimum of three (3) years. <br /> <br />H. DELIVERY POINT: <br />shall be Free on <br />following address: <br />Marcos, Texas. <br /> <br />Delivery of all goods under this contract <br />Board (F. O. B.) to final destination at the <br />Public Works Warehouse, 630 East Hopkins, San <br /> <br />I. DELIVERY SCHEDULE: All items must be delivered wi thin fourteen <br />(14) calendar days of the contract award. Failure to meet this <br />requirement will cause bid to be considered non-responsive. <br /> <br />J. RIGHT TO PURCHASE ELSEWHERE: The City reserves the right to <br />purchase elsewhere all goods covered by this contract if Contractor <br />fails to meet any delivery requirements. <br /> <br />K. ORAL AGREEMENTS: If this bid is accepted and approved by San <br />Marcos City Council, then this bid becomes the contract and there <br />are no oral agreements either expressed or implied. <br /> <br />L. READING OF BIDS: The number of items included in this <br />invitation for bid and the anticipated volume of responses render <br />an oral reading of every line item bid in every bid impractical at <br />the time of opening. As a minimum, bidders name and total amount <br />of bid shall be read aloud. Subsequent to bid opening, a bid <br />tabulation listing all responses will be prepared and made <br />available for inspection to all interested parties prior to the <br />final evaluation and determination of award(s). <br /> <br />M. OR EQUAL: Bids based on items other than those specified by <br />brand names or numbers in the bid must be approved by Bob Ed <br />Cochran, Construction Crew Supervisor. The items offered must be <br />equivalent as to function, basic design, type and qual i ty of <br />material, method of construction, qnd any required dimensions. <br />"Or equal" is intended to establish a level of quality and is not <br />to be interpreted as a preference for a particular brand. Other <br />brands meeting the above minimum requirements will be accepted. <br /> <br />6. SPECIFICATIONS <br /> <br />A. SCOPE OF CONTRACT: The intent of these specifications and <br />resulting contract is to describe pipe and fittings required for <br />the Loop 82 utility Relocation project. <br /> <br />B. QUANTITY REQUIREMENTS: This is a firm fixed-price, estimated <br />quantity contract calling for delivery of the items identified in <br />the Bid Summary Sheet at the stated prices submitted by the bidder. <br />Upon acceptance of a bid by City Council and issuance of a Contract <br />
