<br /> 44 <br /> This AGREEMENT is made this the 12th day of May , <br /> <br /> 19 92 , between the CITY OF SAN MARCOS, TEXAS, hereinafter referred to <br /> as "CITY", 630 East Hopkins, San Marcos, Texas 78666, and CARTER &: <br /> BURGESS, DlC., 700 Lavaca, Suite 1100, Austin, Texas 78701-3102 <br /> hereinafter referred to as "CONSULTANT", for engineering services in <br /> =onnection with design and project management for the rehabilitation of <br /> the airport apron and other improvements to the San Marcos Municipal <br /> Airport. <br /> WITNESSETH: CITY and CONSULTANT do hereby agree as follows: <br /> ARTICLE 1 <br /> CONSULTABT'S SERVICES MID RESPONSIBILITIES <br /> CONSULTANT shall be responsible for the proper, accurate and <br /> adequate design and preparation of plans and specifications, reports <br /> and other contract documents and for contract administration in <br /> connection with improvements to the San Marcos Municipal Airport <br /> hereinafter referred to as the "Project. " <br /> Any provisions in this Agreement pertaining to CITY's review, <br /> .approval and/or acceptance of plans, specifications, construction <br /> contract documents, or other written materials prepared by CONSULTANT <br /> contractors, and subcontractors in connection with this Project shall <br /> not be deemed to diminish CONSULTANT's responsibility therefor. The <br /> CONSULTANT's Basic Services shall consist of the following phases <br /> described in Paragraphs 1.2 through 1. 5. Certain portions of the <br /> CONSULTANT's services are to be performed through the use of <br /> subcontractors to the CONSULTANT. <br /> The CONSULTANT shall notify the CITY prior to retaining any <br /> consulting firms, other than those identified in the CONSULTANT's <br /> proposal for services. <br /> The CONSULTANT shall be responsible to the City for all work <br /> performed by consultants. <br /> Fees for the CONSULTANT's procurement of these services are <br /> included in the CONSULTANT's basic fee described in Article 13 of this <br /> Agreement. <br /> 1.1 STMIDARDS OF PERP'ORJlAlilCE , QUALITY COIl.rROL MID SCHEDULIRG <br /> 1.1.1 The parties hereto agree and understand that CITY is relying <br /> on the CONSULTANT as an expert in the field of airport runway and apron <br />
