<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF
<br /> THE CITY BY ZONING 5.0 ACRES OF LAND OUT OF THE J.M.
<br /> VERAMENDI LEAGUE #1 IN THE CITY OF SAN MARCOS, HAYS
<br /> COUNTY, TEXAS, AS RECORDED IN VOLUME 112, PAGE 330
<br /> OF THE HAYS COUNTY DEED RECORDS, LOCATED AT 1701
<br /> HUNTER ROAD FROM "PD" PRE-DEVELOPMENT DISTRICT TO
<br /> "c" COMMERCIAL DISTRICT AND DECLARING AN EFFECTIVE
<br /> DATE.
<br /> WHEREAS, on December 17, 1991, the Joint Planning and Zoning
<br /> Commissions of the City of San Marcos held a public hearing
<br /> regarding a request to change the zoning from "PD" Pre-Development
<br /> District to "C" Commercial District of 5.0 acres of land of out of
<br /> the J.M. Veramendi League #1 to the City of San Marcos, Texas, as
<br /> recorded in Volume 112, Page 330 of the Hays County Deed Records,
<br /> located at 1701 Hunter Road; and,
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br /> Zoning Commission did, on December 17, 1991 consider the request
<br /> and voted to approve it and has recommended that the request be
<br /> approved by the City Council of the City; and,
<br /> WHEREAS, the City Council held a public hearing on the 8th
<br /> day of June , 1992, regarding the request; and,
<br /> WHEREAS, all requirements of Appendix A, General Zoning
<br /> Ordinance, of the Code of Ordinances of the City of San Marcos
<br /> pertaining to amendments have been met; and,
<br /> WHEREAS, the City Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the
<br /> public health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. That the Official Zoning Map of the City, as
<br /> described in section 3 of the General Zoning Ordinance is hereby
<br /> amended to rezone the following described real property located in
<br /> San Marcos, Hays County, Texas, which was zoned "PDlI Pre-
<br /> Development District upon its annexation to the City of San Marcos
<br /> to "C" Commercial District:
<br /> All of that certain real property situated in Hays County,
<br /> Texas, being 5.00 acres of land out of the J.M. Veramendi
<br /> League #1, Hays County, Texas, and also being a portion of
<br /> that 50 acre tract of land conveyed to Mrs. Guadalupe Lucio,
<br /> widow, by Manuel Lucio, et aI, by deed dated November 14,
<br /> 1936, and recorded in Volume 112, Page 330, of the Deed
<br /> Records of Hays County, Texas, and said property is more
<br /> particularly described by metes and bounds as follows:
<br /> BEGINNING at an iron stake found on the arc of a curve to
<br /> the left in the Southeast line of F.M. Highway #2439 80 foot
<br /> right-of-way, same being the North line of the said Lucio 50
<br /> acre tract, said iron stake being the most Northerly corner
<br /> of a tract of land conveyed to Betty Jean Ybarra by Jose C.
<br /> Lucio, et aI, by deed dated December 16, 1968, and recorded
<br /> in Volume 227, Page 455, of the Deed Records of Hays County,
<br /> Texas, and the most Westerly corner of the tract herein
<br /> described;
<br /> THENCE, leaving the said Ybarra tract, with the said
<br /> Southeast line of F.M. #2439, 206.87 feet along the arc of
<br /> the said curve to the left, having a radius of 2904.93 feet
