RATERNITY AND SORORITY BUILDINGS; PROVIDING FOR <br />~~PPLICATION OF THE PERMIT PROCEDURES AND STANDARDS <br />~~O EXISTING FRATERNITY AND SORORITY BUILDINGS; <br />'. EPEALING ALL CONFLICTING ORDINANCES; PROVIDING A <br />PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN <br />EFFECTIVE DATE. <br />:'1 <br />WHEREAS, on March 3, 1992, the Zoning commission of the City <br />San Marcos (the "Commission") held a public hearing to consider <br />amendment to section 26, lip" Public and Institutional District, <br />subsection (B), of the General Zoning Ordinance; and, <br />WHEREAS, subsequent to that public hearing, the Commission <br />considered and voted to approve the amendment and recommended that <br />the amendment be approved by the City Council; and, <br />WHEREAS, on February 4, 1992, the Commission held a public <br />hearing to consider amendments to section 35, Specific Use Permits, <br />subsections (G) and (H) of the General Zoning Ordinance as well as <br />to consider the application of the amendments to existing uses; <br />and, <br />WHEREAS, subsequent to that public hearing, the Commission <br />considered and voted to approve the amendments and their <br />application to existing uses and recommended that the amendments <br />and such application be approved by the City Council; and, <br />WHEREAS, the City Council held a public hearing on <br />May 11, 1992 ,1992, regarding all of these amendments as well <br />as on the application of the amendments to section 35 (G) and (H) of <br />the General Zoning Ordinance to existing uses; and, <br />WHEREAS, the City council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the <br />public health, morals, welfare, and safety; now, therefore, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. That Section 35(G) of Appendix A- General Zoning <br />Ordinance, of the San Marcos Code of Ordinances is hereby amended <br />by renumbering subdivision (3) thereof as subdivision (4) and by <br />inserting a new subdivision (3) therein to read as follows: <br />(3) Fraternity/sorority buildings: Specific use permits <br /> for fraternity and sorority buildings shall be in <br /> effect for the duration of the organization's use of <br /> the premises unless terminated under any of the <br /> following circumstances. <br /> (a) The Zoning Commission may f following a public <br /> hear ing held under the same procedures as for <br /> initial consideration of the specific use permit, <br /> revoke a specific use permit upon discovery of <br /> any false information provided in support of the <br /> specific use permit application, or for <br /> accumulation of penalty points under subsection <br /> (H) (4) of this section. <br />
