<br /> -2- <br /> (b) If the organization fails either to use an <br /> existing structure, or to begin construction of a <br /> new structure, as a fraternity/sorority building <br /> during the six month period after issuance of the <br /> specific use permit, the permit shall <br /> automatically terminate. <br /> (c) If the use of a fraternity/sorority building is <br /> discontinued by the organization to which a <br /> specific use permit was issued for any period of <br /> six consecutive months after the initial <br /> occupancy has commenced, the permit shall <br /> automatically terminate. <br />SECTION 2. That Section 35(H) of Appendix A- General Zoning <br />Ordinance, of the San Marcos Code of Ordinances is hereby amended <br />by renumbering subdivisions (4) and (5) thereof as subdivisions (5) <br />and (6), and by inserting a new subdivision (4) therein to read as <br />follows: <br />(4) Fraternity/sorority buildings: <br /> (a) A specific use permit and a Certificate of <br /> Occupancy are required for initial occupancy by <br /> each organization in each location. A new permit <br /> and Certificate of Occupancy are required when an <br /> organization moves to a different location or <br /> occupies a location previously occupied as a <br /> fraternity or sorority building by another <br /> organization. Compliance with all applicable <br /> codes and standards shall be determined by the <br /> Chief Building Of£icial prior to issuance of the <br /> Certificate of Occupancy for the initial <br /> occupancy of the prem1.ses by the applicant <br /> organization. <br /> (b) Applications for permits shall be signed by an <br /> officer of the organization and by the owner of <br /> the property. In addition to the required <br /> application form and site plan, the applicant <br /> organization shall provide a written statement <br /> explaining the organization's proposed means of <br /> compliance with these standards, identifying the <br /> names and telephone numbers of the president and <br /> vice president of the organization, and <br /> designating the name, address, and telephone <br /> number of a contact person who shall be an adult, <br /> non-student, such as the property owner, an <br /> alumnus of the organization, a member of the <br /> faculty or staff of Southwest Texas State <br /> University, a parent of a member, or any person <br /> designated by the organization's national <br /> chapter. The contact person shall preferably <br /> have a San Marcos telephone number and, in all <br /> cases, shall reside within 75 miles of San Marcos <br /> as measured from the city limit. <br /> (c) The use of fraternity/sorority buildings and <br /> premises shall comply with the following <br /> requirements as a condition of initial and <br /> continued occupancy of the premises by the <br /> organization. Each requirement is followed by a <br /> penalty point value in parentheses that is <br /> assessed for confirmed violations of the <br /> requirement. A cumulative total of penalty <br /> points is used to establish cause for revocation <br /> of the specific use permit as set forth in <br /> subdivision (4) (f) below. <br />
