attachment in accordance with the City of San Marcos LDC. No irrigation <br />shall be required for undisturbed natural areas or undisturbed existing <br />trees. <br />A natural buffer and park area ranging from 90 -100 feet to the first <br />internal drive and approximately 150 feet from the face of the first <br />Cottage Style units shall be provided adjacent to the northwest property <br />line and shall extend from the rear of the Rowhouse section North LBj <br />Drive all the way to the Spring Lake Hills Nature Preserve as <br />illustrated on the Concept Plan and the Bubble Diagram.. In addition, the <br />developer will construct a 3 to 4 foot wall and landscape berm adjacent <br />to the parking spaces facing Elm Hill Court to screen the parking area <br />and minimize impacts on the adjacent Elm Hill Court residences. This <br />layout is illustrated in Exhibit E incorporated herein. This natural <br />preservation buffer area is intended to serve as a buffer from the rear <br />property lines of the adjacent lots in the Elm Hill Subdivision. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 4. After its original passage, this ordinance will be subject to reconsideration <br />at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is <br />reconsidered and approved, it shall become effective thereafter. <br />PASSED, APPROVED AND ADOPTED on April 2, 2013, subject to reconsideration <br />at the next regularly scheduled City Council meeting on April 16, 2013. <br />Reconsidered: yes l no <br />If yes: approved <br />denied <br />Date: <br />iel <br />Mayor <br />
