<br /> 150 <br /> HISTORIC PRESERVATION COOPERATIVE AGREEMENT <br /> BETWEEN THE CITY OF SAN MARCOS CERTIFIED LOCAL GOVERNMENT <br /> AND HAYS COUNTY CERTIFIED LOCAL GOVERNMENT <br /> WHEREAS, the City of San Marcos ("City") was recognized by the <br /> National Park Service as a certified Local Government on March 29, <br /> 1990, and Hays County ( "County") was recognized as a Certified <br /> Local Government on February 14, 1991; and, <br /> WHEREAS, the City and the County have overlapping <br /> jurisdictions; and, <br /> WHEREAS, the City and the County have many years of <br /> cooperation on historic preservation programs and issues; and, <br /> WHEREAS, the City, a municipality operating under Texas Local <br /> Government Code Chapter 211, recognizes its Historic Preservation <br /> Commission and offers a measure of protection against demolition <br /> and alteration of designated historic properties within its city <br /> limits; and, <br /> WHEREAS, the County has established and maintains a county <br /> historical commission as specified in the Texas Local Government <br /> Code sections 318.001-021 and this Commission coordinates and <br /> promotes historic preservation activities in all of Hays County; <br /> NOW THEREFORE, the City, the County, and the Texas Historical <br /> Commission, agree that a cooperative program shall be administered <br /> in accordance with the following stipulations to facilitate <br /> participation by these local governments in the certified Local <br /> Government program. <br /> stipulations <br /> <br /> The City of San Marcos, through its Historic Preservation <br /> commission and Hays County, through its Historical Commission shall <br /> ensure that the following measures are carried out: <br /> I. REPRESENTATION AT COMMISSION AND COMMITTEE MEETINGS <br /> The City and County shall designate at least one person to <br /> represent the interests of the Certified Local Government at <br /> meetings of the other certified Local Government. Such <br /> representative shall serve as a liaison and therefore not have <br /> voting privileges on matters before the commission or committee. <br /> The representative from the Hays County Historical Commission to <br /> the San Marcos Historic Preservation commission shall be a resident <br /> of the City of San Marcos and shall not serve on any other city <br /> commission during his tenure.
