<br /> 165 <br /> ORDINANCE 1992-~ <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br /> ZONING MAP OF THE CITY BY ZONING 55.00 ACRES <br /> OF LAND OUT OF THE EDWARD BURLESON SURVEY NO. <br /> 18, A-63 BEING A PORTION OF THAT 995 ACRE <br /> TRACT OF LAND CONVEYED TO LOWMAN RANCH, LTD., <br /> BY GRACE B. LOWMAN BY DEED DATED JUNE 3, 1967 <br /> AND RECORDED IN VOLUME 218, PAGE 594, OF THE <br /> HAYS COUNTY DEED RECORDS, LOCATED ON THE EAST <br /> SIDE OF THE 4000 BLOCK OF IH-35 SOUTH FROM <br /> UNZONED, "AR" AGRICULTURAL-RANCH DISTRICT AND <br /> "PD" PRE-DEVELOPMENT DISTRICT TO "c" <br /> COMMERCIAL DISTRICT AND DECLARING AN EFFECTIVE <br /> DATE. <br />WHEREAS, on July 28, 1992, the Zoning commission of the City <br />of San Marcos held a public hearing regarding a request to change <br />the zoning from Unzoned, "AR" Agricultural-Ranch District and "PD" <br />Pre-Development District to "c" Commercial District for 55.00 acres <br />of land out of the Edward Burleson Survey No. 18, A-63 being a <br />portion of that 995 acre tract of land conveyed to Lowman Ranch, <br />Ltd. by Grace B. Lowman by deed dated June 3, 1967 and recorded in <br />Volume 218, Page 594 of the Hays County Deed Records, located on <br />the east side of the 4000 block of IH-35 South; and, <br />WHEREAS, subsequent to the public hearing on that date, the <br />Zoning Commission did, on July 28, 1992, consider the request and <br />voted to approve it and has recommended that the request be <br />approved by the City Council of the City; and, <br />WHEREAS, the City Council held a public hearing on the 24th <br />day of August , 1992, regarding the request; and, <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br />WHEREAS, the City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the <br />public health, morals, welfare and safety; now, therefore, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. That the Official Zoning Map of the City, as <br />described in section 3 of the General Zoning Ordinance is hereby <br />amended to rezone the following described real property located in <br />San Marcos, Hays County, Texas, which presently is partially <br />Unzoned, and partially zoned "AR" Agricultural-Ranch District and <br />"PD" Pre-development District, to "c" Commercial District: <br /> FIELD NOTE DESCRIPTION <br /> OF A SURVEY <br /> OF <br /> 55.00 ACRES OF LAND <br /> OUT OF THE <br /> EDWARD BURLESON SURVEY NO. 18, A-63 <br /> HAYS COUNTY, TEXAS <br /> BEING A PORTION OF THAT 995 ACRE TRACT OF LAND CONVEYED <br /> TO LOWMAN RANCH, LTD. BY GRACE B.
