<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br /> ZONING MAP OF THE CITY BY ZONING 1.652 ACRES
<br /> OUT OF THE J.M. VERAMENDI LEAGUE NO. 2, HAYS,
<br /> COUNTY, TEXAS, BEING A PORTION OF THAT 12.81
<br /> ACRE TRACT OF LAND CONVEYED TO BIMMS
<br /> INVESTMENTS, A TEXAS GENERAL PARTNERSHIP, BY
<br /> RUTH EVANS BY DEED DATED OCTOBER 10, 1983 AND
<br /> RECORDED IN VOLUME 404, PAGE 693, HAYS COUNTY
<br /> DEED RECORDS, LOCATED AT 1200 STATE HIGHWAY 80
<br /> FROM "PD" PRE-DEVELOPMENT DISTIRCT TO "C"
<br /> COMMERCIAL DISTRICT AND DECLARING AN EFFECTIVE
<br /> DATE.
<br /> WHEREAS, on August 25,1992, the Zoning Commission of the City
<br /> of San Marcos held a public hearing regarding a request to change
<br /> the zoning from "PD" Pre-Development District of 1.652 acres out of
<br /> the J.M. Veramendi League No.2, being a portion of that 12.81 acre
<br /> tract of land conveyed to Bimms Investments, A Texas General
<br /> Partnership, by Ruth Evans by Deed dated October 10, 1983 and
<br /> recorded in Volume 404, Page 693, Hays County Deed Records, located
<br /> at 1200 State Highway 80; and,
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br /> Zoning Commission did, on August 25, 1992 consider the request and
<br /> voted to approve it and has recommended that the request be
<br /> approved by the city Council of the city; and,
<br /> WHEREAS, the city Council held a public hearing on the 9th
<br /> day of November , 1992, regarding the request; and,
<br /> WHEREAS, all requirements of, Appendix A, General Zoning
<br /> ordinance, of the Code of Ordinances of the city of San Marcos
<br /> pertaining to amendments have been met; and,
<br /> WHEREAS, the city Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the
<br /> public health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. That the Official Zoning Map of the City, as
<br /> described in Section 3 of the General Zoning Ordinance is hereby
<br /> amended to rezone the following described real property located in
<br /> San Marcos, Hays County, Texas, which is presently zoned "PD" Pre-
<br /> Development District to "C" Commercial District:
