<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY ZONING 10.13 ACRES,
<br />MORE OR LESS, OF LAND AREA IN THE J.M.
<br />VERAMENDI SURVEY NO. ONE, CITY OF SAN MARCOS,
<br />HAYS COUNTY, TExAs, BEING A PORTION OF THAT
<br />TRACT DESCRIBED AS 116.94 ACRES IN A DEED FROM
<br />H.L. SCHULLE TO MARY ANNE HOOD, .TRUSTEE, DATED
<br />NOVEMBER 9, 1973 AND RECORDED IN VOLUME ,263,
<br />PAGE 522 OF THE HAYS COUNTY DEED RECORDS,
<br />LOCATED AT 1500 WONDER WORLD DRIVE FROM "PD"
<br />PRE-DEVELOPMENT DISTIRCT TO "MF-3" MULTI-
<br />FAMILY DISTRICT (HIGH DENSITY) AND DECLARING
<br />AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on October 6,1992, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "PD" Pre-Development District to "MF-3" Multi-
<br />family District (High Density) for 10.13 acres, more or less, of
<br />land area in the J.M. Veramendi League No. One, being a portion of
<br />that tract described as 116.94 acres in a deed from H.L. Schulle to
<br />Mary Anne Hood, Trustee, dated November 9, 1973 and recorded in
<br />Volume 263, Page 522 of the Hays County Deed Records, located at
<br />1500 Wonder World Drive; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Zoning commission did, on October 6, 1992 consider the request and
<br />voted to approve it and has recommended that the request be
<br />approved by the City Council' of the city; and,
<br />
<br />WHEREAS, the city Council held a public hearing on the 23rd
<br />day of November, 1992, regarding the request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determin~s that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />SECTION 1. That the Official zoning Map of the city, as
<br />described in section 3 of the General Zoning Ordinance is hereby
<br />amended to rezone the following described real property located in
<br />San Marcos, Hays County, Texas, which is presently zoned "PD" Pre-
<br />Development District to "MF-3" Multi-family District (High
<br />Density) :

<br />DESCRIPTION OF A SURVEY OF 10.13 ACRES, MORE OR LESS, OF
<br />LAND AREA IN THE J.M. VERAMENDI SURVEY NO. ONE, CITY OF
<br />SAN MARCOS, HAYS COUNTY, TEXAS, BEING A PORTION OF THAT
<br />TRACT DESCRIBED AS 116.94 ACRES IN A DEED FROM H.L.
<br />SCHULLE TO MARY ANNE HOOD, TRUSTEE, DATED NOVEMBER 9,
<br />1973 AND RECORDED IN VOLUME 263, PAGE 522 OF THE HAYS
<br />COUNTY DEED RECORDS, AND BEING MORE PARTICULARLY
<br />DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

<br />BEGINNING at a 3/4" iron pipe found at a 'fence corner in
<br />a northeast line of that tract descibed as 166.670 acres
<br />in a deed from T-D 350 Investments to M R Properties
<br />dated April 29,1987 and recorded in volume 670, page 497
<br />of the Hays County Real Property Records for the south
<br />corner of this tract and the aforereferenced Hood 116.94
<br />acre tract and for the west corner of that tract
<br />described as 7 acres in a deeè from Longina Velasquiz et
<br />al to Epifanio Velasquiz et ux dáted August 19, 1968 and
