(2) The Board shall have the power to authorize; upon 13{PP appeal in specific cases such variances from the terms of this ordinance as will not be contrary to the publ ic interest; where, owing to special conditions; a literal enforcement of the provisions of this ordinance will result in unnecessary hardship, and so that the spirit of this ordinance shall be observed and substantial justice done. Variances may be granted to any prov~s~on except for the listing of permitted or specific uses, and except for procedural requirements. SECTION 11. That if any word, phrase; clause; sentence, or paragraph of this ordinance is held to be unconstitutional I or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 12. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 13. That any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in Section 1-5 of the San marcos Code of Ordinances. SECTION 14. That this Ordinance shall be in effect ten (lØ) days from and after its passage, and it shall be published in a newspaper of general circulat~on in the area as required by the Charter of the City of San Marcos, Texas.
