<br />(F) Where a townhouse is not separated from an adjacent J3~c' <br />structure by a wall having the minimQm fire rating <br />of two hours ~in accordance with Section 4Ø3 of the <br />Standard Building Code, the setback from each side <br />lot line shall be 7 1/2 feet; except as provided in <br />the district regulations for sipe setbacks adjacent <br />to streets on carner lots. <br /> <br />SECTION 8. That Section 37(A)(25) Off. Street Parking; <br />Minimum Requirements, of Appendix A, General Zoning Ordinance <br />of the San Marcos Code of Ordinances is amended to clarify <br />the standard regulating the location of required ofr street <br />parking to read as follows: <br /> <br />( 25) Except - as provided in Section 41 ( C) (4) for <br />circumstances that may be approved by the <br />zoning Board of Adjustments as a special <br />exception, all required" off-street parking <br />spaces shall be located on the same lot or <br />tract as the principal 'use or uses being <br />served by the parking area. <br /> <br />SECTION 9. That Section 41(C)(4), Powers of the Board <br />o'f Adjustments; of Appendix A,. General Zoning Ordinance of <br />the San Marcos Code of Ordinances be amended to redesignate <br />subparagraphs (c), (d) and (e) to (d), (e) and (f) <br />respectively, and to add a special exception to provide <br />relief in certain circQmstances tò the standard requirements <br />for off-street parking as a new s.ubparagraph (c) to read as <br />follows: ~ <br /> <br />(4) To grant special exceptions in the following <br />instances: <br /> <br />(c) To allow off-site parking where all or part of <br />the minimum number of parking spaces required <br />in Section (37)(A) are located within 3ØØ feet <br />on a lot or tract of land that is legally <br />separate from the property containing the <br />principal use served by the parking area as <br />follows: , <br /> <br />(1) provided that both lots or tracts are <br />under the same ownership; or, <br /> <br />(2) provided that it can be established that <br />two or more uses, applying jointly and <br />concurrently for the special exception, <br />will be ~ sharing- a parking area that may <br />be on property tnat is not under the same <br />ownership âs one or more of the uses to <br />be served by the: parking, where the <br />shared parking area has a capacity of at <br />least the minimum number of spaces for <br />the use having the greatest minimum <br />rèquirement,- where all uses have their <br />primary need for parking during off <br />setting periods so that the parking area <br />will be utilized by only one principal <br />use at a time, and where such arrangement <br />is docQmented through a long-term lease <br />or other written agreement. <br /> <br />SECTION lØ. That Section 4l(C)(2), Powers of Board of <br />Adjustments, of Appendix A of the General Zoning Ordinance of <br />the San Marcos Code of Ordinances be - amended to delete <br />subparagraphs (a), (b), (c), (d) .and (e)' regarding the types <br />of pro'visions that are eligible for the granting of a <br />variance by the Zoning Board of Adjustment and by aménding <br />subdivision (2) to read as follows: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />I ' <br />
