<br /> 13(p!3 <br /> Ordinance, of the San Marcos Code of Ordinances is amended to <br /> add subsection (2) to read as follows: <br /> (2) Fraternity/sorority buildings not located on <br /> property owned by a college or university. <br /> SECTION 6. That Section 35(H) (3) (a) (2) and Section <br /> 35(H) (3) (g) (4) of Appendix A, General Zoning Ordinance, of <br /> the San Marcos Code of Ordinances are amended with regCtrd to <br /> the regulation of TABC specific use permits to read as <br /> fol1Öws: <br /> - <br /> (3) Establishments dispensing alcoholic beverages for <br /> on-premise consumption (to be called a TABC specific use <br /> permit) : <br /> (a) Procedures: - - <br /> \ <br /> (2) The Director shall review the application <br /> form and site plan in accordance with <br /> Section 35(D) for completeness. Except <br /> as provided -in Section 35(H)(3)(g) for <br /> the issuance of 'certain TABC specific use <br /> permits - thro ugh an administrative <br /> process, the Dirf:ctor shall place the <br /> application- on the Zoning Commission <br /> calendar for its consideration and notify <br /> all land owners' within 2ØØ feet of the <br /> site. ~ <br /> (g) Alcoholic Beverage Specific Use Permit <br /> Required: <br /> (4) Specific use permits may be approved <br /> administratively by the Director at the <br /> time a new state TABC permit is required <br /> for a currently permitted establishment <br /> due solely to a change in the person <br /> holding the permit, and where no other <br /> aspects of, the business or physical <br /> premises are being changed except to <br /> improve compliance with the standards <br /> contained in Section (H)(3)(b). Any <br /> aspects of the premises which are legally <br /> nonconforming wi th reg ard to screenlng, <br /> off-street parking, lighting, and <br /> siíJnage, as regulated in Section <br /> 35(H) (3) (b) -(3, 5 , 6 and 7), are exempt <br /> from compliance- and may be continued, <br /> provided that any future changes <br /> voluntarily undertaken by the proprietor <br /> or .property owner are in compliance with <br /> the applicable standards. The Director <br /> may disapprove - the application due to <br /> knowledge of excessive problems, <br /> complaints, or violations related to the <br /> operation of the establishment. An <br /> application which is administratively <br /> denied shall be scheduled by the Director <br /> on the next possible Zoning Commission <br /> agenda for its consideration in <br /> accordance with the standard public <br /> hearing process for new permits. <br /> : <br /> SECTION 7. That Section 36(F), Supplemental Area <br /> Requirements, of Appendix A, General- Z~ni'ng Ordinance- of the <br /> San Marcos Code of Ordinances is amended to delete 'the 15 <br /> foot side setback requirement for townhouses to read as <br /> follows: - - . <br />
