<br />GAø <br /> <br /> <br /> <br />CITY OF SAN MARCOS <br /> <br />. <br /> <br />RULES AND REGULATIONS FOR ELECTRIC SERVICE <br />DEPOSITS (continued) <br /> <br /> <br />B. Amount of Deposit <br /> <br />(1) The required deposit for residential and general <br />services customers shall be the greater of <br /> <br />a. $50.00 or <br /> <br />b. fln amount equivalènt to one-sixth (1/6) of either <br />the estimated annual billings to that service <br />location or an estimated annual billing to similar <br />dwellings or services. <br /> <br />(2) The City may require a deposit sufficient to reasonably <br />protect it ßgainst the assumed risk of temporary, <br />weekend, or personal service, provided such policy is <br />applied in a uniform and non-discriminatory manner. <br />~ <br /> <br />These deposits shall be returned according to guidelines set <br />out in subsection G. below. <br /> <br />C. Subject to these rules, an applicant shall not be required to <br />pay a deposit: <br /> <br />(1) if the applicant is applying for a similar service and <br />has been a customer of the San Marcos Electric utility <br />or its predecessor at one location within the last <br />twelve (12) months and has had service at that location <br />for a mlnlmum of three (g) years and during the last <br />twentY-four (24) consecutive months of service did not <br />have more than two (2) occasions in which a bill for <br />such utility service was paid after becoming delinquent. <br /> <br />(2) if it is a new applicant for service under the larger <br />general service rate (500 kW or greater) and it provides <br />the San Marcos Electric utility an irrevocable letter of <br />credi t from a bank or lending institution approved by <br />the City in the amount equivalent to a deposit <br />calculated according to section B of these rules. Such <br />letter of credit must be approved by the city Attorney <br />and must contain a provision that any litigation <br />concerning the letter of credit must be filed in Hays <br />County, Texas. <br /> <br /> <br /> <br /> <br /> <br /> <br />-41- <br />
