2)Pt 1. 00 DEFINITIONS 1. 01 City - City of San Marcos, Texas. 1. 02 Commodity - Material that can be sold in a spot or future market for processing and use or reuse. Each Commodity shall retain its own identity and be kept separate. 1. 03 Commodity Buyer - A buyer or processor, selected by Contractor pursuant to the Contract Documents, of Recyclable Materials delivered by Contractor. 1.04 Container - A receptacle designed for the purpose of curbside collection of Recyclable Materials. The receptacle shall be one made of fiberglass or plastic that has been accepted by other cities with experience in curbside recycling. If the City elects to experiment with newly designed types of recycling receptacles, the Contractor has the right to accept or reject any new design. 1. 05 Contract Documents - Contractor's Proposal, General Specifications, and any addenda or changes to the foregoing documents agreed to by the City and the Contractor. ~ 1. 06 Contractor - Browning-Ferris, Inc. 1. 07 Recyclable Material(s) - Those commodities which are collected by Contractor pursuant to the Contract Documents. The definition of Recyclable Materials is subject to change pursuant to Section 2.01(e) of these General Specifications. 1. 08 Residential Unit - A dwelling within the corporate limits of the City served by the City's Solid Waste Collection Contractor. ' 2.00 SCOPE OF WORK 2.01 General (a) The work under this Contract shall consist of the items contained in the Proposal, including all the supervision, materials, equipment, labor and all other items necessary to complete said work in accordance with the Contract Documents. In the event of a flood, hurricane or other Act of God, the City may suspend Recyclable Materials collection and the Contractor and the City will negotiate the payment to be made to the Contractor. 18572 - 4 -
