<br /> -""b <br /> ""- -" <br /> \ - ¿..... <br /> improvements may be carried forward from year to year, but under no <br /> circumstances will Lessor be responsible for the costs of any capital <br /> improvements made by the Lessee that exceed the fixed rental fees due <br /> and payable during the term of this Lease. <br /> D. Payment of Rent. <br /> <br /> Fixed rental consideration due and payable by Lessee to Lessor <br /> : to paragraph III(A) and III(B) above shall <br /> ' 9ursuant be paid quarterly, <br /> in advance, no later than the tenth (10th) day after the closing of <br /> each quarterly paYment period. The first paYment due under paragraphs <br /> A(l), B (1) and B(2) shall be due and payable on or before the tenth <br /> (10th) day after the execution of this Agreement with subsequent <br /> paYments being due and payable on or before the tenth (10th) day after <br /> the expiration of three (3) months following the date of execution of <br /> this Agreement. Variable fees due under paragraphs A~) and A ( 3) shall <br /> be due and payable on or before the tenth (lOth) day after the <br /> expiration of three (3) months following the date of execution of this <br /> Agreement and every three (3) months thereafter. A copy of invoices, <br /> delivery and sales receipts, bills, and other written evidence to <br /> substantiate the amount of consideration due Lessor shall accompany <br /> , <br /> each variable fee paYment by Lessee. PaYment of all consideration <br /> shall be made to the City of San Marcos, Texas, at 630 E. Hopkins, San <br /> Marcos, Texas, 78666. All financial records of Lessee pertaining to <br /> the amount of consideration due pursuant to this Agreement shall be <br /> subject to audit and inspection by Lessor during all regular business <br /> hours of Lessee. <br /> IV. Maintenance of Demised Premises. <br /> A. Maintenance Responsibilities of Lessee. <br /> <br /> Lessee shall be responsible for the maintenance, repairs, upkeep <br /> and janitorial maintenance of the interior of demised premises <br /> described in Exhibit "A", excluding the existing heating and <br />: ventilation equipment and the public areas of the aviation terminal <br />I <br />L building and the grounds surrounding the terminal building. Lessee <br /> shall at all times keep the same in a sanitary, safe and sightly <br /> condition and in a state of good repair.. Lessee shall be responsible <br /> for the paYment of all utility charges incurred other than charges for <br /> electricity and water usage. <br /> -5- <br />
