<br /> 3:;"£ <br /> Lessee shall be responsible for all maintenance, repairs and <br />upkeep of the demised premises described in Exhibit "B". Lessee shall <br />at all times keep said demised premises free of all debris, grass, <br />weeds, rubbish, brush and all other unsightly or unsanitary matter and <br />shall maintain said premises in a safe condition and in a state of good <br />repair. Lessee agrees to bear the costs of installation of any <br />::tdditional utility lines or connections. Lessee shall pay any and all <br />~tility charges for service to said premises. <br /> Lessee, as FBO of the airport, shall be responsible for the upkeep <br />and maintenance of the aviation fuel storage and dispensing facility, <br />and shall maintain the same in accordance with all federal, state and <br />local regulations, standards and requirements provided, however, that <br />to the extent the need for repair and/or replacement for an underground <br />fuel storage tank (s) and/or pipe(s) is the result of deterioration due <br />to such equipment's age exceeding its useful life, of a change in <br />federal, state or local regulations, or of other causes beyond Lessee's <br />control, Lessor shall be responsible for such cost of repair and/or <br />replacement. Notwithstanding anything herein to the contrary, Lessee <br />shall be responsible for the cost of repair and/or replacement directly <br /> , <br />attributable to Lessee's negligence, misconduct or neglect, or the <br />negligence, misconduct or neglect of Lessee's employees, sub-tenants, <br />concessionaires, contractors, invitees or licensees. Lessor represents <br />and warrants to Lessee that as of the date of this Lease, there are <br />three (3) underground fuel storage tanks in the Aviation Fuel Storage <br />and Dispensing Facility, that all three (3) are registered with the <br />Texas Water Commission, and that to the best of Lessor's knowledge, <br />there are no material deficiencies with the facility. <br /> In the event that the current fuel storage and dispensing facility <br />should become unusable, Lessor will provide an alternate suitable <br />location for Lessee to establish a workable fuel storage and dispensing <br />facility. <br /> B. Maintenance Responsibilities of Lessor. <br /> Maintenance of the runways, taxiways, entrance roads, driveways <br />and existing parking lots leading to and/or contiguous to the demised <br />premises described in Exhibit A and B and unoccupied property of <br /> -6- <br />
