40 RESOLUTION 1991- 2R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE RELEASE OF EASEMENTS LOCATED ON LOT THREE OF THE C LARE~'mO D ADDITION TO THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS TO EIGHTEEN SAN MARCO CORPORATION; AUTHORIZING THE CITY MANAGER TO EXECUTE THE RELEASE AND QUITCLAIM; AND DECLARING AN EFFECTIVE DATE. VJHEREAS, on December 2, 1935 an electric power line easement was granted to the Texas Power and Light Company in an instrument recorded in Volume llØ, Page 523 of the Hays County Deed Records; and, WHEREAS, on July 15, 1938 an electric power line easement was granted to the Texas Power and Light Company in an instrument recorded in Volume 117, Page 18Ø of the Hays County Deed Records; and, WHEREAS, on October 3Ø, 1986 the aforesaid easements were assigned to the City of San Marcos by the Lower Colorado River Authority in an instrument recorded in Volume 634, Page 818 of the Hays County Deed Records; and, WHEREAS, it has been determined by the City that the aforesaid easements are no longer necessary because new easements have been reserved for the City on the plat of the property recorded in Volume 4 of Page 22 of the Hays County Plat Records; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of a document from the City of San Marcos to Eighteen San Marco Corporation releasing and quitclaiming electric powerline easements located on Lot three of the Clarewood Addition to the City of San Marcos, a copy of which is attached hereto and incorporated herein for all intents and purposes, are hereby approved. PART 2. That the City Manager, Larry D. Gilley, is hereby authorized to execute this release on behalf of the City of San Marcos. PART 3.
