<br /> 59 <br /> LEASE AGREEMENT <br /> STATE OF TEXAS * <br /> COUNTY OF HAYS * <br /> This Lease Agreement ("Lease") is entered into effective February <br /> 1, 1991 between the City of San Marcos ("CITY") and the Hays County <br /> Appraisal District (" HCAD" ). <br /> In consideration of the obligation of HCAD to pay rent and in <br /> consideration of the other terms, covenants and conditions of this <br /> Lease, the CITY leases to HCAD, and HCAD takes from the CITY a 9,000 <br /> square foot area ("leased premises" or " premises") located in the <br /> ground level portion of the City of San Marcos Municipal Building (the <br /> "Building"). In addition, during the term of this Lease and any <br /> extensions thereto the CITY agrees to make available at all times to <br /> the HCAD, at a location adjacent to the Building, a minimum 0 f forty <br /> (40) parking spaces to be used in conjunction with HCAD's use of the <br /> leased premises. <br /> The Lease shall be for five (5) years with the monthly rent fixed <br /> for a period of three (3) years at the price set out in ARTICLE I, and <br /> for years four (4) and five (5) to be renegotiated based on the then <br /> current market value. <br /> ARTICLE I <br /> RENT <br /> 1.1 Rent shall accrue from the effective date of this Lease and <br /> shall be payable at the CITY's Finance Office. <br /> HCAD shall pay the CITY rent in advance in equal monthly <br /> installments of SIX THOUSAND FOUR HUNDRED EIGHTY and no/100 <br /> DOLLARS ($6,480.00) per month, or SEVENTY-TWO cents ($.72) per <br /> square foot. The first monthly installment shall be due and <br /> payable on or before the tenth day from the effective date of <br /> this Lease, and subsequent monthly installments shall be due and <br /> payable on or before the first day of each succeeding calendar <br /> month during the term of the Lease. <br /> 1.2 The parties to this Lease acknowledge that the performance <br /> and services provided for under this Lease must be paid from <br />
