59 LEASE AGREEMENT STATE OF TEXAS * COUNTY OF HAYS * This Lease Agreement ("Lease") is entered into effective February 1, 1991 between the City of San Marcos ("CITY") and the Hays County Appraisal District (" HCAD" ). In consideration of the obligation of HCAD to pay rent and in consideration of the other terms, covenants and conditions of this Lease, the CITY leases to HCAD, and HCAD takes from the CITY a 9,000 square foot area ("leased premises" or " premises") located in the ground level portion of the City of San Marcos Municipal Building (the "Building"). In addition, during the term of this Lease and any extensions thereto the CITY agrees to make available at all times to the HCAD, at a location adjacent to the Building, a minimum 0 f forty (40) parking spaces to be used in conjunction with HCAD's use of the leased premises. The Lease shall be for five (5) years with the monthly rent fixed for a period of three (3) years at the price set out in ARTICLE I, and for years four (4) and five (5) to be renegotiated based on the then current market value. ARTICLE I RENT 1.1 Rent shall accrue from the effective date of this Lease and shall be payable at the CITY's Finance Office. HCAD shall pay the CITY rent in advance in equal monthly installments of SIX THOUSAND FOUR HUNDRED EIGHTY and no/100 DOLLARS ($6,480.00) per month, or SEVENTY-TWO cents ($.72) per square foot. The first monthly installment shall be due and payable on or before the tenth day from the effective date of this Lease, and subsequent monthly installments shall be due and payable on or before the first day of each succeeding calendar month during the term of the Lease. 1.2 The parties to this Lease acknowledge that the performance and services provided for under this Lease must be paid from
