<br /> 4.2 HCAD shall prevent any lien or obligation from being credited <br /> against or imposed upon the premises by reason of any alteration, <br /> repair, labor performed or materials furnished to the premises for <br /> or on behalf of HCAD. <br /> ARTICLE V <br /> UTILITIES <br /> 5.l CITY shall pay all charges for electricity, gas, water, <br /> wastewater and garbage services to the premises. HCAD shall pay <br /> all charges for telephone services to the premises. <br /> 5.2 The CITY shall not be liable to HCAD for any interruption in <br /> utility services, except where any such interruption results <br /> solely from the CITY's failure to pay all charges for said <br /> electricity, gas, water, waste water and garbage services to the <br /> premises. <br /> ARTICLE VI <br /> INSURANCE AND INDEMNITY <br /> 6.1 The CITY shall not be liable to HCAD or to any other person <br /> on the premises for any loss or damage to the person or property <br /> of HCAD or any other person caused by an act of negligence of the <br /> HCAD or any employee, officer or agent of the HCAD, and the HCAD <br /> hereby agrees to indemnify and defend the CITY and hold it <br /> harmless from any loss, expense and claim arising out of such <br /> damage or injury. <br /> 6.2 The CITY shall procure and maintain throughout the term of <br /> this Lease insurance coverage, insuring the CITY as well as the <br /> HCAD from all claims, demands, or actions concerning that portion <br /> of the premises as set forth in Section 2.4 of this Lease <br /> Agreement, including the outside of the building, signs, <br /> sidewalks, serviceways, loading areas and the forty (40) parking <br /> spaces made the subject of this Lease Agreement. In addition, the <br /> CITY will procure and maintain throughout the term 0 f this Lease <br /> fire and casualty insurance on the Building, for its full value. <br /> HCAD shall procure and maintain fire and casualty insurance for <br /> the contents of the leased premises, and liability insurance <br /> covering the leased premises. <br /> -4- <br />
