<br /> ARTICLE III <br /> MAINTENANCE AND REPAIR OF PREMISES <br /> 3.1 The CITY shall keep the leased premises (limited to the <br /> foundation, exterior walls and windows, air conditioning system, <br /> electrical system, plumbing system, ceiling, roof, and parking <br /> spaces made the subject of this Lease) in good, clean condition <br /> and shall make all needed repairs. The CITY shall comply at its <br /> sole cost and expense with all governmental laws, ordinances and <br /> regulations applicable to the premises, except that the CITY shall <br /> not be obligated to make any structural changes or alterations to <br /> the premises unless made necessary by the act or omission of the <br /> CITY. HCAD shall maintain the inside of the leased premises and <br /> all its furnishings and fixtures in good condition and shall make <br /> all needed repairs to them. At the expiration of this Lease, HCAD <br /> shall surrender the premises in good condition, reasonable wear <br /> and tear, loss by fire, or other unavoidable casualty alone <br /> excepted. <br /> ARTICLE IV <br /> ALTERATIONS AND FIXTURES <br /> 4.l HCAD shall not make any alterations, additions, or <br /> improvements to the leased premises without the prior written <br /> consent of the CITY, except for the installation of unattached <br /> movable trade fixtures. All alterations, improvements and <br /> fixtures (other than unattached, movable trade fixtures) which may <br /> be made or installed by either party upon the premises shall <br /> become the property of the CITY at the termination of this Lease, <br /> and shall remain upon and be surrendered with the premises, <br /> unless the CITY requests their removal, in which event HCAD shall <br /> remove them and restore the premises to its original condition at <br /> HCAD's expense. Any linoleum, carpeting, or other floor covering <br /> which may be affixed to the floor of the premises, and any <br /> paneling or other wall covering shall also become the property of <br /> the CITY upon termination of this Lease, all without credit or <br /> compensation to HCAD. <br /> -3- <br />
