<br />limousines. <br />Sec. 15~-12. Issuance of limousine oÞerator's Þermit. <br /> duration. <br />(1) Upon submission of a completed application for a <br />limousine operator's permit, a permit shall be issued <br />bearing the name, address, signature and photograph of the <br />applicant. <br />(2) The permit shall be in effect for the remainder of <br />the calendar year in which it is issued. <br />Sec. 15~-13. Sus~ension or revocation. <br /> <br />Every limousine operator receiving a permit under the <br />terms of this chapter shall comply with all city, state and <br />federal motor vehicle laws. Failure to do so will justify <br />the suspension or revocation of this permit by the municipal <br />court judge. The chief of police may initiate a revocation <br />or suspension by filing a petition with the municipal court <br />judge. No permit shall be suspended or revoked unless <br />notice and an opportunity to be heard have been provided the <br />holder of the permit. <br />Sec. 15~-14. Vehicles: equipment and maintenance. <br /> <br />(a) Any vehicle operated pursuant to the terms of this <br />chapter shall be inspected as required by state law, and <br />shall be maintained in a safe and sanitary operating <br />condition at all times. <br />Sec. 15~-15. Restrictions on oÞeration of luxury and <br /> airÞort limousine services. <br /> <br />(a) It shall be unlawful for a person to operate a <br />vehicle other than a luxury vehicle equipped with a <br />partition separating the driver from the passenger <br />compartment, in the provision of a luxury limousine service. <br />(b) It shall be unlawful for a person, in the operation <br />of an airport limousine service, to depart from the fixed <br />routes designated in the certificate or to pick up or <br />discharge passengers at locations other than those shown on <br />such fixed routes. <br />(c) The fixed routes of an airport limousine service on <br />a certificate may be amended with the consent of the city <br />council after a public hearing. <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br />SECTION 3. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br />SECTION 4. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty provided in section 1-5 <br />of the San Marcos Code of Ordinances. <br />SECTION 5. That this Ordinance shall be in effect ten (10) <br />days from and after its passage, and it shall be published in a <br />newspaper of general circulation in the area as required by the <br />Charter of the City of San Marcos, Texas. <br />PASSED AND APPROVED on first reading January 14, 1991. <br />
