<br /> 114 <br /> LEASE AGREEMENT <br /> STATE OF TEXAS * <br /> COUNTY OF HAYS * <br /> KNOW ALL MEN BY THESE PRESENT: <br /> This Lease Agreement ("Lease") is entered into effective <br /> March 12 , 1991 between the City of San Marcos ("CITY"), a <br /> municipal corporation, and Community Action, Inc. of Hays, Caldwell <br /> and Blanco Counties ("CA"), a nonprofit corporation existing under the <br /> laws of the State of Texas. <br /> In consideration of the obligation of CA to pay rent and in <br /> consideration of the other terms, covenants and conditions of this <br /> Lease, the CITY leases to CA, and CA takes from the CITY the building <br /> located at 611 West Martin Luther King Boulevard and all adjacent area <br /> property associated therewith ("leased premises" or "premises"). The <br /> legal description of the leased premises is attached hereto as Exhibit <br /> "A." <br /> The term of this Lease shall be for twenty (20) years. <br /> ARTICLE 1 <br /> RENT <br /> 1.1 Rent shall accrue from the effective date of this Lease and <br /> shall be payable at the CITY's Finance Office. <br /> CA covenants and agrees to pay to CITY as rent for the <br /> premises the sum of One Dollar ($1.00) per annum, due and payable <br /> on or before the first working day of January of each year. <br /> ARTICLE 2 <br /> USE AND CARE OF LEASED PREMISES <br /> 2.1 The leased premises shall be used and occupied only for the <br /> purpose of operating The Family Planning Clinic and for no other <br /> purposes without prior written consent of the CITY. CA shall not <br /> at any time leave the leased premises vacant, but shall in good <br /> faith continuously throughout the term of this Lease conduct and <br /> carry on in the premises the type of business for which the <br /> premises are leased, and shall keep the premises open to the <br /> public for business during normal business hours. <br />
