<br /> ARTICLE 5 <br /> UTILITIES <br /> 5.1 CA shall pay all charges for electricity, gas, telephone <br /> services, water, wastewater and garbage services to the premises. <br /> 5.2 The CITY shall not be liable to CA for any interruption in <br /> utility services. <br /> ARTICLE 6 <br /> FEES <br /> 6.1 CITY agrees to waive all building permits, impact and other <br /> fees it may lawfully collect from CA in connection with <br /> construction performed by or on behalf of CA on the leased <br /> premises. <br /> ARTICLE 7 <br /> INDEMNITY <br /> 7.1 CA does hereby covenant and agree to defend, indemnify and <br /> save harmless CITY from all damages, claims, losses, demands, <br /> suits, judgments, costs including reasonable attorney's fees and <br /> expenses arising out of the use of the leased premises by CA, its <br /> agents or employees or anyone for whose acts CA may be liable for <br /> the provision of services and assistance to families utilizing the <br /> Family Planning Clinic. Indemnification shall occur whenever <br /> damages losses, demands, suits, judgments, costs including <br /> reasonable attorney's fees and expenses are caused in whole or <br /> part by any negligent act or omission of CA, CA's agents, employee <br /> or anyone for whose acts CA may be liable. <br /> ARTICLE 8 <br /> INSURANCE <br /> 8.1 CA agrees to keep and maintain in effect, fire insurance with <br /> extended coverage, in a sum not less than the replacement value of <br /> all improvements upon the leased premises with a company or <br /> companies licensed to so insurance business in Texas and CITY <br /> shall be named as an additional insured on the policy or <br /> policies. Copies of the policy or policies shall be provided to <br /> the CITY within thirty (30) days from the effective date of this <br /> Lease, and renewal certificates shall be provided to the CITY no <br /> later than December 31 of each year of this Lease. <br /> -4- <br />
