premises shall be subject to approval by the City. CA shall cause any construction on the leased premises to be prosecuted with diligence and shall cause all required building permits for the construction or renovation to be obtained. 3.3 During the term of this Lease, CA shall not permit any mechanics' or materialmen's lien (or any other liens) to be filed against the leased premises or CA's leasehold interest in the leased premises and nothing in this Lease shall be deemed or construed in any way as constituting the consent or request of the CITY, expressed or implied, by inference or otherwise, to any contractor, subcontractor, laborer or materialman for the performance of any labor or the furnishing of any materials for any specific improvement, alterations or repair of the leased premises or any part thereof. ARTICLE 4 MAINTENANCE AND REPAIR OF PREMISES 4.1 CA shall keep the leased premises and any structures or improvements constructed or placed thereon in good, clean condition at all times during the term of this Lease. CA at its own cost and expense shall make all repairs, including structural repairs necessary during the term of this Lease. 4.2 CA shall comply at its sole cost and expense with all governmental laws, ordinances and regulations applicable to the premises. 4.3 CA shall keep the sidewalks and parking areas in good condition and repair, and shall provide the necessary maintenance to the yard and keep all landscaped area in a sightly condition. 4.4 The leased premises shall be kept free from all refuse and obstructions. CA shall promptly remove all garbage and refuse of any kind from the premises during the term of this Lease. 4.5 At the expiration of this Lease, CA shall surrender the premises in good condition, reasonable wear and tear, loss by fire, or other unavoidable casualty alone excepted. -3-
