26 LEASE AGREEMENT STATE OF TEXAS * COUNTY OF HAYS * KNOW ALL MEN BY THESE PRESENT: This Lease Agreement ("Lease") is entered into effective April 9 , 1991 between the City of San Marcos ("CITY"), a municipal corporation, and Hays County Homespun, ECI., Inc. (" HS " ) I a nonprofit corporation existing under the laws of the State of Texas. In consideration of the obligation of HS to pay rent and in consideration of the other terms, covenants and conditions of this Lease, the CITY leases to HS, and HS takes from the CITY the building located at 401 Jackman Street and all adjacent area property associated therewith ("leased premises" or "premises"). The legal description of the leased premises is attached hereto as Exhibit "A." The term of this Lease shall be for one (1) year, with automatic renewals thereafter for successive one (1) year periods unless there is at least a thirty (30) day advanced written notice of termination by either party. ARTICLE 1 RENT 1.1 Rent shall accrue from the effective date of this Lease and shall be payable at the CITY's Finance Office. HS covenants and agrees to pay to CITY as rent for the premises the sum of One Dollar ($1.00) per annum, due and payable on or before the first working day of January. ARTICLE 2 USE AND CARE OF LEASED PREMISES 2.1 The leased premises shall be used and occupied only for the purpose of operating the Homespun Program and for no other purposes without prior written consent of the CITY. HS shall not at any time leave the leased premises vacant, but shall in good faith continuously throughout the term of this Lease conduct and carry on in the premises the type of business for which the premises are leased, and shall keep the premises open to the public for business during normal business hours.
