<br /> -3- <br /> UTILITIES <br /> 4.1 HS shall pay all charges for electricity, gas, telephone <br /> services, water, wastewater and garbage services to the premises. <br /> 4.2 The CITY shall not be liable to HS for any interruption in <br /> utility services. <br /> ARTICLE 5 <br /> INDEMNITY <br /> 5.1 HS does hereby covenant and agree to defend, indemnify and <br /> save harmless CITY from all damages, claims, losses, demands, <br /> suits, judgments, costs including reasonable attorney's fees and <br /> expenses arising out of the use of the leased premises by HS, its <br /> agents or employees or anyone for whose acts HS may be liable for <br /> the provision of services and assistance to families utilizing the <br /> Homespun Program. Indemnification shall occur whenever damages <br /> losses, demands, suits, judgments, costs including reasonable <br /> attorney's fees and expenses are caused in whole or part by any <br /> negligent act or omission of HS, HS's agents, employee or anyone <br /> for whose acts HS may be liable. <br /> ARTICLE 6 <br /> INSURANCE <br /> 6.1 HS agrees to keep and maintain in effect, fire insurance with <br /> extended coverage, in a sum not less than the replacement value of <br /> all improvements upon the leased premises with a company or <br /> companies licensed to so insurance business in Texas and CITY <br /> shall be named as an additional insured on the policy or <br /> policies. Copies of the policy or policies shall be provided to <br /> the CITY within thirty (30) days from the effective date of this <br /> Lease. <br /> 6.2 In the event the leased premises, a major portion thereof or <br /> any structures or improvements located on the leased premises <br /> shall be damaged or destroyed by casualty, fire or otherwise, to <br /> an extent which renders the leased premises unfit for HS's <br /> purposes, as HS may determine, HS may rebuild or repair such <br /> damaged or destroyed portions. <br /> 6.3 HS shall give immediate written notice pursuant to Section <br /> 13.1 of this Lease to the CITY of any damages caused to the <br /> premises by fire or other casualty. <br />
